  • If the Indenture Trustee determines pursuant to paragraph (a) above that a Class A-2 Deficiency Amount would exist, the Indenture Trustee shall complete a Notice in the form of Exhibit A to the Policy and submit such notice to the Insurer no later than the close of business New York City time on the Business Day following the related Determination Date preceding such Payment Date as a claim for a payment in an amount equal to the Class A-2 Deficiency Amount.
