Guaranteed Completion Date definition

Guaranteed Completion Date means the date set forth across from the corresponding unit or phase of Trade Contractor Work on the Outline of Construction Schedule set forth below.
Guaranteed Completion Date shall be three hundred sixty-five (365) calendar days after the Judicial Council's issuance of Notice to Proceed to Licensee as provided in Section 8.2 and subject to extensions, if any, as mutually agreed by the Parties in writing.
Guaranteed Completion Date shall have the meaning as set forth in Exhibit A-1 as such date shall be adjusted for events, conditions and/or delays outside of Contractor’s reasonable control or as otherwise provided for herein.

Examples of Guaranteed Completion Date in a sentence

  • If the COD has not occurred by the Guaranteed Completion Date, Licensee shall pay the Judicial Council as liquidated damages the amount of three hundred dollars ($300) for each calendar day (or part day) after the Guaranteed Completion Date until such time that the COD occurs.

  • If COD has not occurred within ninety (90) calendar days of the Guaranteed Completion Date, the Judicial Council reserves the right to terminate this SLA by written notice to Licensee.

  • The Construction Start Date and the Guaranteed Completion Date may also be extended by the mutual written agreement of the Parties.

  • In the event of a Force Majeure, the Construction Start Date and the Guaranteed Completion Date shall be extended pursuant to the provisions in Section 14.4 of this SLA provided that Licensee exercises its best efforts to mitigate any delay caused by such Force Majeure.

  • Change Orders shall contain full particulars of the Changes, and any adjustments of the Contract Price, Project Schedule, Guaranteed Completion Date or Performance Guarantees, and any other modification to this Agreement.

Guaranteed Completion Date shall have the meaning set forth in Exhibit 4 of the Trade Contract Agreement.
Guaranteed Completion Date means the date set forth across from the corresponding unit or phase of Trade Contractor Work on the Outline of Construction Schedule set forth below. The following Outline of Construction Schedule highlights critical components of the Project and mandatory Milestone Dates that must be completed, without exception, by the Trade Contractor in order to meet the requirements of the Construction Schedule and Substantial Completion. The Parties acknowledge and agree, in accordance with Paragraph 2.11 to the Trade Contract Agreement, that the Trade Contractor will undertake Extraordinary Measures if the Authority determines that the performance of the Trade Contractor Work has not progressed or reached the level of completion required by the Milestone Dates for Trade Contractor’s Work in the Outline of Construction Schedule or if Trade Contractor’s Work is interfering with or delaying the Construction Manager’s work and timely Completion of the Construction Manager’s work pursuant to the Master Project Schedule. Design and Install of
Guaranteed Completion Date means the Milestone Deadline for Substantial Completion as set forth in Exhibit VIII. For the avoidance of doubt, the Guaranteed Completion Date shall be 120 days after Notice to Proceed, as such date may be adjusted from time to time pursuant hereto.
