Phase I of the Project definition

Phase I of the Project means the development of the initial 100 MW of energy capacity and accompanying data center(s) associated with the Project (i.e., 0 MW – 100 MW of the Project).
Phase I of the Project means activities under the Project ready for implementation during the period of approximately 2008 through 2010, set forth in the Attachment to the Appendix, as said Attachment may be revised from time to time with the mutual agreement of the Recipient and the Association.
Phase I of the Project means the development of the Site and other parcels owned and/or leased by Developer and located in the City of Berea for a multi-purpose community field, hotel, sports medicine facility, multifamily apartments, restaurants, parking garage and other mixed-uses.

Examples of Phase I of the Project in a sentence

  • The City’s obligation to make payments under Sections 8.3.1, 8.3.2 and 8.3.3. shall terminate on December 31 of the year that is: (i) fifteen (15) years from January 31, 2028 with respect to Phase I of the Project and (ii) fifteen (15) years from January 31, 2030 with respect to Phase II of the Project.

  • The Redeveloper shall be obligated to obtain all approvals required from Governmental Authorities having jurisdiction for Phase I of the Project.


More Definitions of Phase I of the Project

Phase I of the Project means the development of the Site for a multi-purpose community field, hotel, sports medicine facility, multifamily apartments, restaurants, parking garage and other mixed-uses.
Phase I of the Project as used in sections 13(f), (g) and 22 of this Agreement shall mean at a minimum the following: A rehabilitated school consisting of approximately 12-20 single bedroom units as a phase I development. In the event that Purchaser fails to comply with the Schedule through no fault solely of Seller or as a result of a force majeure, Seller may deliver a written default notice to Purchaser. In the event Purchaser fails to cure the default within ninety (90) days after receipt of such default notice, Purchaser shall be liable to Seller for Delay Damages until such default is cured by Purchaser. Any appeal of a landuse decision by a third party shall toll the Schedule until said appeal is finally resolved. Restrictions on Seller’s Right to Sell Prior to Completion of the Project: Notwithstanding anything in this Agreement to the contrary, Purchaser shall have no right to sell, gift, transfer or otherwise assign, in whole or in part (collectively, a “Sale”, regardless of whether or not monetary consideration was exchanged between Purchaser and any assignee) the Premises or the Project, in whole or in part, prior to obtaining a building permit for and commencement of construction of Phase I of the Project. Without limitation of the generality of the foregoing sentence, any assignment of a controlling interest in Purchaser shall be deemed a Sale for purposes of this section. Any Sale in violation of the terms of this Agreement shall be null and void, which Sale restrictions shall be memorialized in and a condition of the deed to the Premises from Seller to Purchaser.:
Phase I of the Project. The Tenant shall contribute $5,100,000 to the Landlord, or such other party as is designated by Landlord, on the date of execution by the Landlord and Tenant of this Amendment for the community/aquatic center and the baseball and soccer fields which shall be in full satisfaction of Tenant’s obligations with respect to the community/aquatic center and the baseball and soccer fields. The Tenant has substantially completed the Environmental Remediation, subject to receipt of ano further action” letter from the Missouri Department of Natural Resources. Not later than December 31, 2007, Tenant shall start to construct the Gaming Facilities and the Project Roadway in a first class manner in accordance with all laws, regulations, ordinances and permit requirements (collectively, “Government Requirements”) and otherwise in accordance with the terms of the Lease (the “Work”). Title to Tenant’s personalty and fixtures and Tenant’s Gaming Facilities and those items that are part of Phase II of the Project shall at all times during the term of this Lease remain with Tenant, subject to the provisions of Section 5(e).
Phase I of the Project means the (i) development, construction and operation of the Gaming Facilities on the Property which shall mean a minimum 90,000 square foot casino containing not less than 2000 slots and 50 table games, three restaurants, a gift shop and parking sufficient to service the aforesaid facilities (the “Gaming Facilities”), (ii) the Environmental Remediation of the Landlord’s Property and the Known Conditions of the Access Road Property, (iii) a contribution by Tenant in the amount of $5,100,000 to the Landlord, or such other party as is designated by Landlord, for the construction of the community/aquatic center and the soccer fields; and (iv)the development and construction of the Project Roadway, including replacement of the ▇▇▇▇▇ Road Bridge (hereinafter defined). Tenant has completed Phase I of the Project with a total investment of not less than $375,000,000. “Phase II of the Project” shall mean the development and construction on the Property of: (i) a hotel with a minimum of 200 rooms with lobby; (ii) a meeting room/event space of not less than 10,000 square feet that is adjacent to the hotel with a capacity of at least 500 guests with sit-down tables or 750 guests in the absence of tables; and (ii) a parking garage with a minimum of 1600 spaces. Tenant intends to make a total investment of not less than $78,000,000 on Phase II of the Project. Phase I and Phase II of the Project are collectively called the “Project”.” A new Exhibit C to the Lease and Development Agreement is substituted entitled “Essential Elements”, which is attached to hereto as Exhibit 1.
Phase I of the Project means the (i) development, construction and operation of the Gaming Facilities on the Property which shall mean a minimum 90,000 square foot casino containing not less than 2,300 slots and 50 table games, three restaurants, a gift shop and parking sufficient to service the aforesaid facilities (the “Gaming Facilities”), (ii) the Environmental Remediation of the Landlord’s Property and the Known Conditions of the Access Road Property, (iii) a contribution by Tenant in the amount of $5,100,000 to the Landlord, or such other party as is designated by Landlord, for the construction of the community/aquatic center and the baseball and soccer fields; (iv) development and construction of a hatch shell to be located on the Park Property, and (v) the development and construction of the Project Roadway, including a replacement of the ▇▇▇▇▇ Road Bridge (hereinafter defined). The Tenant shall make an investment of not less than $375,000,000 on Phase I of the Project. “Phase II of the Project” shall mean (i) the development and construction of a hotel with a minimum of 100 rooms and (ii) some combination of additional hotel rooms, an entertainment/meeting space, additional casino space, additional restaurants, retail space, movie theatres, bowling lanes, or other amenities and additional parking spaces sufficient to serve the aforesaid facilities, as mutually agreed to by Tenant and Landlord, which are intended to increase revenues to the Property. The Tenant shall make an investment of not less than $75,000,000 on Phase II of the Project. The Landlord and the Tenant anticipate that Phase II of the Project may comprise approximately 280,000 square feet but the aggregate square footage will depend on the components selected. Phase I of the Project and Phase II of the Project are collectively referred to as the “Project.” A new Exhibit C to the Agreement is substituted entitled “Essential Elements”, which is attached hereto as Exhibit 1.

Related to Phase I of the Project

  • Cost of the Project means and embraces the cost of construction; the cost of all

  • Project means the goods or Services described in the Signature Document or a Work Order of this Contract.

  • The Project Site, where applicable, means the place or places named in the SCC.

  • The Project means supply, installation, testing and commissioning, integration of computer hardware and services with support under Warranty and annual maintenance contract, if required for the contract period.
