Unacceptable Performance definition

Unacceptable Performance means any of the following:
Unacceptable Performance means a persistent failure to fulfill duties of the position to high standards and in a manner that serves the best interests of the Association and the University, as determined by the University President after consulting with the Board of Directors.
Unacceptable Performance. ’ means per- formance of an employee which fails to meet established performance standards in one or more critical elements of such employee’s po- sition.

Examples of Unacceptable Performance in a sentence

  • To do so, the Board must provide the Executive with a notice of termination specifying the Termination Date and either the specific act(s) or failure(s) constituting Unacceptable Performance or the circumstances constituting Disability.

  • If the notice identifies an act or failure constituting Unacceptable Performance, it shall be accompanied by a resolution duly adopted by a majority of the entire membership of the Board and, if the act or failure is subject to correction under the definition of Unacceptable Performance and related definitions in this Agreement, the notice shall also specify the period during which the act or failure must be corrected, which in no event shall be less than thirty (30) days.

More Definitions of Unacceptable Performance

Unacceptable Performance means (i) inappropriate or unprofessional attire or (ii) illegal, potentially illegal or patently offensive behavior.
Unacceptable Performance means provider action(s), or lack thereof, that fails to satisfy the requirements of the contract.
Unacceptable Performance means performance of an employee which fails to meet established performance standards in one or more critical elements of such employee's position.
Unacceptable Performance means failure to attain reasonable business goals established by Employer continued for 30 days without correction after notice specifically identifying the obligations not being performed.
Unacceptable Performance means the Executive’s (i) act or omission constituting Cause, (ii) willful and material failure to perform the duties of his/her employment (except in the case of a Termination of Employment for Adequate Reason or on account of the Executive’s physical or mental inability to perform such duties), provided that the Executive does not cure such failure within five (5) days after receiving written notice from the Board specifying such failure in detail, (iii) willful and material violation of the Company’s code of ethics or written harassment policies, or (iv) intentional breach of a material term or condition of this Agreement, provided that the Executive does not cure such failure within five (5) days after receiving written notice from the Board specifying such failure in detail.
Unacceptable Performance means any of the following: the Executive's act or failure to act constituting willful misconduct or gross negligence that is materially injurious to the Employer or its reputation; the Executive's material failure to perform the duties of her employment (except in the case of a Termination of Employment for Good Reason or on account of the Executive's physical or mental inability to perform such duties) and the failure to correct such failure within a reasonable period after receiving written notice from the Board of Directors describing such failure in detail; the Executive's violation of any code of ethics or business conduct or written harassment policies of the Employing Companies that continues after the Board has provided notice to the Executive that the continuation of such conduct will result in Termination of the Executive's Employment; the requirement or direction of a federal or state regulatory agency having jurisdiction over the Company that the Executive be removed from her position or the institution by such an agency of a formal enforcement proceeding against the Company or the Executive specifically naming the Executive as a person with substantial involvement in the acts (or omissions) that are the subject of such proceeding, and seeking that the Executive cease and desist from such acts (or omissions) in connection with her duties or seeking civil money penalties as a result of her past acts (or omissions); the Executive's arrest or indictment for (i) a felony or (ii) lesser criminal offense involving dishonesty, breach of trust, or moral turpitude; or the Executive's breach of a material term, condition, or covenant of this Agreement and the failure to correct such breach promptly following receipt of written notice from the Board of Directors describing such breach in detail.
Unacceptable Performance means a persistent failure to fulfill duties of the position to high standards and in a manner that serves the best interests of the Corporation and the University, as determined by the University President after consulting with the Board of Directors, or the Chairperson or other Board-designated officer as the Corporation’s authorized executive for this purpose.
