Working Condition definition

Working Condition means the environment as it appears in the employee’s working premises including various conditions in the working areas, machinery, buildings, location, air ventilation, heat, light, noise, and as well as conditions and working characteristics of an employee.

Working Condition means operating in the manner in which the item was designed to operate. “Cosmetic 302 Conditions” means aesthetic imperfections that do not affect Working Condition of the item, including, but not 303 limited to: pitted marcite; tears, worn spots and discoloration of floor coverings, wallpapers, or window 304 treatments; nail holes, scrapes, scratches, dents, chips or caulking in ceilings, walls, flooring, tile, fixtures, or 305 mirrors; and minor cracks in walls, floor tiles, windows, driveways, sidewalks, pool decks, and garage and patio 306 floors. Cracked roof tiles, curling or worn shingles, or limited roof life shall not be considered defects Seller must 307 repair or replace, so long as there is no evidence of actual leaks, leakage or structural damage. 308 (iii) General Property Repairs: Seller is only obligated to make such general repairs as are necessary to bring 309 items into the condition specified in Paragraph 12(b) (ii) above. Seller shall within 10 days after receipt of ▇▇▇▇▇’s 310 written notice or General Inspection report, either have the reported repairs to General Repair Items completed 311 at Seller’s expense, or have repairs estimated by an appropriately licensed person and a copy delivered to 312 Buyer, or have a second inspection made by a Professional Inspector and provide a copy of such report and 313 estimates of repairs to Buyer. If ▇▇▇▇▇’s and Seller’s inspection reports differ and the parties cannot resolve the 314 differences, ▇▇▇▇▇ and Seller together shall choose, and equally split the cost of, a third Professional Inspector, 315 whose written report shall be binding on the parties. 316 If cost to repair General Repair Items equals or is less than the General Repair Limit, Seller shall have repairs 317 made in accordance with Paragraph 12(f). Working Condition means operating in the manner in which the item was designed to operate; (2) “Cosmetic Conditions” means aesthetic imperfections that do not affect the Working Condition of the item, including, but not limited to: pitted marcite or other pool finishes; missing or torn screens; fogged windows; tears, worn spots, or discoloration of floor coverings, wallpaper, or window treatments; nail holes, scratches, dents, scrapes, chips or caulking in ceilings, walls, flooring, fixtures, or mirrors; and minor cracks in floors, tiles, windows, driveways, sidewalks, or pool decks; and (3) cracked roof tiles, curling or worn shingles, or limited roof life shall not be considered defects Seller must repair or replace, so long as there is no evidence of actual leaks or leakage or structural damage, but missing tiles will be Seller’s responsibility to replace or repair.

Working Condition means operating in the manner in which the item was designed to operate. The Professional Inspection is not intended to discover or note cosmetic conditions and SELLER is not obliged to cure cosmetic conditions or to bring any item into compliance with current building codes unless necessary to put an item in working condition. “Cosmetic Condition" means visible aesthetic imperfections which do not affect the working condition of the item, such as, but not limited to, tears, worn spots and discoloration of floor coverings, wallpapers, or window treatments, nail holes, scratches, dents, scrapes, chips and caulking in bathroom ceiling, walls, flooring, tile, fixtures or mirrors, and minor cracks in windows, driveways, sidewalks, pool decks, garage floors and patio floors. Fogged windows are deemed not to be a cosmetic condition. BUYER must, within fifteen (15) days after acceptance of this Agreement, deliver to SELLER written notice of any items which are not in the condition required and a copy of the inspector's written report, if any.

Working Condition means filling/emptying operations associated with the external floating roof storage tanks.
