2:02 Employees outside the Scope of this Agreement shall not perform the regular duties of the Employees within the Scope of this Agreement, except for the purposes of instruction, experimentation or during an immediate emergency.
2:03 All newly proposed positions will be considered jointly by the Employer and the Union to determine if the position should be included or excluded from the Scope of this Agreement. The Union shall be notified a minimum of ten (10) calendar days prior to the position being posted. Where either Party requests a face-to-face meeting, such meeting will occur within the ten (10) day period prior to the posting of the new position. Such meeting shall not result in a delay of the posting of the new position.
00 - SCOPE. 1:01 The provisions of this Agreement shall apply to all full time firefighters employed by the Corporation of the City of Kingston, save and except Fire Chief, Deputy Chief (2), Executive Officer, clerical support staff and volunteer firefighters. Whenever the singular, masculine or feminine is used in this Agreement, it shall be considered as if the plural, feminine or masculine has been used where the context of the party or parties hereto so require.

Students working during summer recess (May 1 to September 15) and students regularly employed for not more than twenty (20) hours per week. Part-time non-student employees regularly employed for not more than twenty (20) hours per week. Casual employees called in to replace full-time employees who cannot perform their regular duties due to sickness, accident, vacation or pregnancy. Employment of students working on educational career programs and Federally/Provincially assisted make-work programs will be by mutual agreement which will not be unreasonably withheld by the Union. Any part-time, casual or temporary employees earning Union rates will automatically pay Union dues but are not represented by our Local, subject to dues being paid on a proportional basis.

00 - SCOPE. 2.01 The Employer recognizes the Labourer’s International Union of North America, Local 506 as the exclusive bargaining agent for all employees of the Employer employed at the existing facilities in the City of Toronto save and except assistant supervisors, persons above the rank of assistant supervisors, all clerical, office, sales and security staff.

3.02 In the event that this Agreement's terms and conditions place the Contractor in an uncompetitive position with alternate Unions or non‐union bidders, this Agreement may be altered accordingly by mutual agreement of the Unions and Contractor. 3.03 The Parties agree that the Employment Standards Act forms part of this Agreement, except those provisions specifically modified by this Agreement.
