Access Data Sample Clauses
The Access Data clause defines the rights and conditions under which one party may access, use, or retrieve data belonging to another party. Typically, this clause outlines what types of data are accessible, the methods or systems through which access is granted, and any limitations or security requirements that must be observed. Its core function is to ensure that data sharing is conducted transparently and securely, preventing unauthorized use and clarifying the responsibilities of each party regarding data access.
Access Data. If the website is visited without any information regarding the person, the GRB only stores the access data. These comprise, for example, the date and time of access, the referrer, the web browser used and the name of the service provider. No person-related analysis of the data takes place. The GRB solely analyses the data for statistical purposes.
Access Data. PFPC shall provide to the Funds and the Funds agree to use AccessData’s SalesVision sales, compensation and compliance tracking and reporting services (“SalesVision”) as follows:
(i) At project initiation, Access Data/PFPC will begin a project to implement SalesVision to support internal sales, compensation and compliance reporting for the “GE Funds” and the “Elfun Funds” identified on Exhibit A. PFPC shall implement these SalesVision-related services based on the following current assumptions; provided, however, that to the extent the expected usage of these services material exceeds the following assumptions, PFPC and the Funds will determine whether to negotiate in good faith additional compensation:
(A) Total classes of shares for “GE Funds” are approximately 48 and for “Elfun Funds” are approximately 6;
(B) Monthly transaction volumes for “GE Funds” are approximately 22,000 (1,000 per day) and for “Elfun Funds” are approximately 5,500 (300 per day);
(C) Total accounts for “GE Funds” are approximately 85,000 and for “Elfun Funds” are approximately 75,000;
(D) The Funds will outsource the hosting services to Access Data/PFPC; and
(E) PFPC/The Funds will perform data stewardship tasks.
(ii) PFPC/Access Data will convert the “GE Funds” and “Elfun Funds” transaction history for 2003 and YTD 2004 utilizing the PFPC settled trade file.
(iii) The Funds agree to be a reference for the SalesVision/PFPC product offering and permit PFPC/Access Data to list the Funds as a SalesVision client.
Access Data. 32.1. You will notify FXTM immediately if you know or suspect that your Access Data has or may have been disclosed to any third person.

22.1. You agree to keep your Access Data secret and not to disclose it to any person.
22.2. You will notify us immediately if you know or suspect that your Access Data has or may have been disclosed to any third person.
22.3. In case we suspect unauthorised access to (due to your actions or not) or Access Data for your Trading Platform, we will terminate access to your Trading Account to investigate.
22.4. You agree to co-operate with any investigation we may conduct into any misuse of your Access Data.
22.5. You will be liable for all Orders given through and under your Access Data. Any such Orders received by us will be considered as given by you, unless establish that the Orders in question were a result of unauthorised access at no fault on your side.
22.6. You are solely responsible for providing and maintaining the compatible equipment necessary to access and use of the Trading Platform.
22.7. You acknowledge that we bear no responsibility if unauthorised third persons have access to information. This includes electronic addresses, electronic communication and personal data. This applies when the above are transmitted using:
a) the internet or other network communication facilities;
b) telephone;
c) post; or
d) any other electronic means.
Access Data. (1) The Licensor shall provide the Licensee with the access data once the software agreement has been concluded.
(2) The Licensee shall keep the access data secret and provide access exclusively to those employees who are authorised to use it. The Licensee must report any misuse or loss of access data. The Licensor is entitled to immediately block the access data and will provide the Licensee with corresponding new access data.
(3) For each individual case in which the Licensee discloses its access data to third parties or otherwise enables third parties to use the software, the Licensor shall be entitled to claim liquidated damages from the Licensee in the amount of the fee for one year for one user. The damages shall be set higher or lower if the Licensor proves higher damages or the Licensee proves that lower damages or no damages at all have been incurred. In the event that further damages are claimed, including against the third party, the liquidated damages shall be credited.
(4) In the event of unauthorised use or transfer of use to third parties, the Licensee shall, upon request, provide the Licensor with all necessary details about the third party that are known to the Licensee to enable the Licensor to make any claims for compensation, in particular name, address and date and scope of the use

Access Data. To properly provide you the Services and to operate and assess the Program and their IoT operations, Jewelers Mutual and HSB will have access to, and may monitor, your Portal and Mobile App. Jewelers Mutual and HSB also will access certain data, including without limitation, data and metadata collected by the Equipment at your location and/or provided by you or Jewelers Mutual to HSB, or transmitted through the Portal, Mobile App and/or any other Program-related website, web application, or mobile application (e.g., an enrollment site or application) (“Data”). By signing below you give permission to Jewelers Mutual and HSB to access the Data. Jewelers Mutual and HSB may indefinitely use all information collected or learned during the Program, including any such Data, as Jewelers Mutual or HSB see fit so long as the Data is anonymized prior to being shared with any unaffiliated third party (other than third party service providers necessary to the operation of the Program (for example, a third party portal provider)).
