Accumulated Overtime. Union personnel will be allowed to accumulate up to a maximum of eighty (80) hours overtime in the calendar year. No time off will be allowed in lieu of overtime between June 1st and September 1st unless a waiver of these regulations is obtained from Senior Management and must be attributable to extenuating circumstances. All accumulated overtime shall be taken as time off at a mutually acceptable time no later than May 31st of each year, for the previous years' overtime. Any accumulated time left at the end of May 31st shall be paid out in June at the employee's current classified rate.
Accumulated Overtime. A. Hours prior to October 8, 1989 ("old" hours)
1. An employee shall retain the right to use these "old" hours provided such time off does not adversely impact the employee's unit or division as determined by the commanding officer.
2. Management may buy back any of these accumulated overtime hours in excess of 496 hours, at the discretion of the Chief of Police.

1. To ensure that all FLSA overtime worked is compensated in cash, overtime hours worked must be turned in pursuant to policies adopted by the Department following meeting and conferring as required by law. If the correct amount of overtime compensation cannot be determined by the first payday following the DP in which the overtime was worked because the employee did not submit the necessary and correct documentation showing the hours worked, then so long as such payment is made no later than the payday following the pay period during which the necessary and correct documentation was received, such payment(s) shall not be considered to have been delayed longer than is reasonably necessary pursuant to the FLSA as interpreted by the Department of Labor at 29 C.F.R. §778.106.
2. Beginning on the date this MOU is approved, the Department may at its discretion require employees to use CTO time in excess of 250 hours in order to reduce the balance in an employee’s CTO bank. The Department shall provide the employee with at least 24 hours notice prior to the start of the shift for which the employee is required to use CTO time. The ability of the Department to require employees to use CTO time in accordance with this provision will sunset on June 30, 2011, unless specifically extended by the parties.
3. Management may buy back any accumulated overtime hours in the new bank. Prior to doing so, Management will give employees notice that it intends to buy back such time.

Accumulated Overtime. (a) The employee shall have the option of taking overtime as pay or accumulating the overtime and taking the same as time off with pay.
(b) The employee shall declare, in advance quarterly by the first of January, April, July and October their option to receive pay for overtime or time off at the appropriate overtime rate for the overtime hours worked during the quarter.
(c) An employee may at any time request all or part of his overtime as time off. The requested time off shall be granted provided that the employee and the Employer mutually agree to the period to be taken off.
Accumulated Overtime. An employee shall have the option of accumulating overtime up to a maximum of ten (10) non-replenishable regular workdays at any time during the vacation year. The time may be taken at a time mutually agreed between the employee and the Employer.

Accumulated Overtime. All accumulated overtime will be paid out at the rate earned. Employees will be allowed to accumulate up to a maximum of sixty (60) hours overtime from December 1st to November 30th in any year. Time off in lieu of overtime must be at a time selected by mutual agreement between Employer and employee and is not normally to be taken to extend annual vacation. Accumulated overtime not taken will be paid out on the first pay period in December.
28.02 For the purposes of calculating overtime the following factors shall be applied:
a. For all time worked over seven (7) hours and up to ten (10) hours in a day or over thirty-five (35) hours in a week, one and one-half (1 1/2) times the straight time hourly rate.
b. For all time worked over ten (10) hours in a day, two (2) times the straight time hourly rate. Assistant Technical Directors working 40 hours per week, shall have overtime calculated as noted below. The following times shall be paid at one and one-half (1 1/2) the appropriate straight time rate:

b) The member shall have the option of receiving their overtime pay on their next pay period or banking up to a maximum of one hundred (100) hours of overtime for time off at a later date.
c) Members who elect to bank such time will not have the option of converting banked time to paid time at a later date except as provided under clause (e).
d) Members may be required to utilize any banked time upon notice of resignation until the termination date with the exception of any scheduled court time.
