Acting in a Higher Position. (a) Subject to the provisions of sub-clauses (b) and (c) of this clause, a tenured lecturer who relieves for another lecturer holding a position to which a higher salary is payable, shall be paid for the period which the lecturer is so relieving at a rate agreed between the employer and the lecturer. (b) The lecturer must perform the extra duties and undertake the responsibilities of the higher position for a period of at least ten consecutive days. Where more than one person fulfils the higher duties, the allowance is pro-rated for the duration of that period. (c) Leave periods including special leave shall not be counted as part of or deemed to interrupt the qualifying period specified in sub-clause (b) of this clause if the lecturer continues in the higher position immediately after the period of leave. (d) A lecturer who does not resume in the higher position immediately after the leave and who is being paid additional salary in a relieving position on the day preceding the leave is to be paid the additional salary during the leave for a period equal to one-fourth of the period of employment in the higher position or until the end of the leave period, whichever is the shorter period.
Acting in a Higher Position. 5.14.1 Subject to the provisions of subclause 5.14.2 and 5.14.3 of this clause, a tenured ASM who relieves for another employee holding a position with special responsibilities for which a higher salary is payable, shall be paid for the period which the ASM is so relieving at a rate agreed between the employer and the ASM.
Acting in a Higher Position. 5.5.1 Subject to the provisions of this section, a kaimahi who relieves for another kaimahi holding a position to which a higher salary is payable, shall be paid for the period which the kaimahi is relieving at a rate agreed between the employer and the kaimahi. 5.5.2 The kaimahi must perform the extra duties and undertake the responsibilities of the higher position for a period of at least five consecutive working days for a higher rate to be negotiated. 5.5.3 Leave periods, including special leave, shall not be counted as part of, nor deemed to interrupt the qualifying period specified in clause 5.5.2 of this clause if the kaimahi continues in the higher position immediately after the period of leave.

A staff member may be asked to act in a higher position for less than five consecutive days without any additional payment. (c) Leave periods, including special leave, shall not be counted as part of, or deemed to interrupt, the qualifying period specified in subclause (b) of this clause if the staff member continues in the higher position immediately after the period of leave. (d) An abated rate of allowance may be paid where less than full duties and responsibilities of the higher position are performed. (e) A staff member who does not resume in the higher position immediately after the leave and who is being paid additional salary in a relieving position on the day preceding the leave, is to be paid the additional salary during the leave for a period equal to one-fourth of the period of employment in the higher position or until the end of the leave period, whichever is the shorter period.‌‌‌

Acting in a Higher Position. When an absence occurs in the positions of Sergeant, Lieutenant, Captain, Deputy Chief or Assistant Chief, and said absence continues from day to day for a period in excess of seven (7) calendar days, the Chief shall assign an Officer to act in the capacity of the absent position. If it is determined that an absence will continue in excess of seven (7) calendar days, and said position is determined by the Chief to be of critical importance, he may, at his sole discretion, fill said absence by appointing from the first day of absence. If another Officer of the equivalent or higher rank is in a position to assume the responsibilities of the absent Officer’s position, then the Chief is not required to assign an officer to such position. During service in the acting capacity, the Officer so assigned shall be compensated at the base salary of the higher position, plus his or her own longevity or seniority pay beginning on the rate of such acting assignment by the Chief. Excepted from this provision is any absence created by operation of Article 3 of this agreement. If a vacancy is not filled within thirty (30) calendar days in the rank of Sergeant, Lieutenant, Captain, Deputy Chief or Assistant Chief, and the position is not eliminated, then the Chief shall appoint temporarily from the next lower rank some Officer to fill that position until a permanent officer is assigned to fill said vacancy.
Acting in a Higher Position. 4.5.1 Subject to the provisions of this section, an employee who relieves for another employee holding a position to which a higher salary is payable, shall be paid for the period which the employee is relieving at a rate agreed between the employer and the employee. 4.5.2 The employee must perform the extra duties and undertake the responsibilities of the higher position for a period of at least five consecutive working days for a higher rate to be negotiated. 4.5.3 Leave periods, including special leave, shall not be counted as part of, nor deemed to interrupt the qualifying period specified in clause 4.5.2 of this clause if the employee continues in the higher position immediately after the period of leave.

  • Other Positions Executive shall immediately resign, and shall be deemed to have immediately resigned without the requirement of any additional action, from any and all position Executive holds with the Company and its Affiliates on Executive’s Date of Termination.

  • Permanent Positions All part-time and full-time positions shall be permanent unless identified as being fixed term in accordance with clause 2.2.5.

  • Term Position A position occupied by a full-time or part-time nurse for a specified period of time, up to a maximum of sixty (60) weeks, where patient/client/resident census or workload necessitates a temporary increase in staffing, if mutually agreed, to replace a nurse(s) who is/are on vacation or leave of absence, or to carry out a special short term project or where the Employer has provided notice of permanent deletion of position(s) under the Memorandum of Understanding regarding Employment Security, or as otherwise mutually agreed between the Union and the Employer. If the Employer determines there is a term position to be filled by a nurse, the term position shall be posted in accordance with Article 30. This shall not preclude the Employer from utilizing part-time nurses and/or casual nurses to work available shifts as specified in Articles 34 and 35 when the Employer decides that a term position is not required. The Employer shall provide written confirmation of the start and expiry dates of the term position prior to the nurse's commencement in the position. This period may be extended if the Employer so requests and the Union agrees. The maximum duration specified in paragraph 1 above for term positions shall not apply in situations where a nurse is absent indefinitely due to Workers Compensation and/or illness and/or accident or where there is a temporary vacancy due to leave for Public Office. In these cases, the Employer shall state on the job posting that the said term position is an "Indefinite Term" which will expire subject to a minimum of twenty-four

  • Not Acting in Individual Capacity Except as provided in this Article VI, in accepting the trusts hereby created Wilmington Trust Company acts solely as Owner Trustee hereunder and not in its individual capacity, and all Persons having any claim against the Owner Trustee by reason of the transactions contemplated by this Trust Agreement or any Basic Document shall look only to the Owner Trust Estate for payment or satisfaction thereof.
