Common use of Additional Hours Clause in Contracts

Additional Hours. (a) Seniority in regard to claiming a schedule with more hours shall apply to Clerk's Helpers, Snack Bar employees and Combination Take-Out Bar employees within their respective classifications and within the store in which they work, insofar as is practical and feasible. Such employees shall have no seniority over apprentices or experienced clerks, nor shall their seniority apply toward experienced clerk's status. (b) An employee on the "available" list may exercise his seniority over other employees in accordance with the provisions of this Section regardless of whether such other employees are on either the "available" or "self-restricted" list. If the offer is rejected for any reason, the employee, by such rejection, is automatically placed on the "self-restricted" seniority list and may not opt for the "available" seniority list until the second (2nd) selection period following the rejection. (d) In the event an employee attains sixteen (16) consecutive full-time weeks of employment in the store in which he is employed or is hired full-time, the one-for-one remedy shall apply, provided a more senior available employee in the store who has the skill and ability to perform the work involved successfully grieves. The Employer’s obligation to promote the most senior “available” part-time clerk commences upon the Union’s written notification to the Employer of the fact.

Additional Hours. ‌ The Employer will fill extra shifts that become known to Employer at least seven (a7) days in advance of that shift by posting a list of open shifts with space for Bargaining Unit Employees to sign up for those shifts. If more than one Bargaining Unit Employee signs up for the same shift, then that shift will be assigned to the competing Bargaining Unit Employees in rotating order of Seniority (once a Bargaining Unit Employee has received a shift in regard this manner in a given month, then that Bargaining Unit Employee shall go to claiming the bottom of the list for receiving such assignments in all months.). If no Bargaining Unit Employee signs up for the shifts at least two (2) days prior to the shift, then the Employer may assign those shifts through the method below. Extra shifts that are not filled at least two (2) days before the shift will be filled pursuant to this Section. Additional Hours. (aPre FTIP) Seniority This clause applies to part time and auxiliary associates until FTIP is implemented and then to the new part time classification. Additional hours are hours that become available once all the regular schedules have been posted for any given week. A part time associate wishing to work additional hours in regard a scheduling area other than their own scheduling area, may submit in writing such request to claiming the Personnel and Office Supervisor indicating their availability. Such request will be received by the Company three times a schedule with more year for the one month periods prior to February 1, June 1 and September 1. Should such an associate wish to amend their request, they must do so in writing to the Personnel and Office Supervisor during the periods stipulated above. The Company will provide to the designated ▇▇▇▇▇▇▇ a list of part time associates who have requested additional hours. Additional hours arising in a department or a group of departments where associates are normally cross-scheduled within a scheduling area, shall apply first be assigned to Clerk's Helpers, Snack Bar employees associates who work in that department(s) and Combination Take-Out Bar employees within their respective classifications and within then to associates working in the store scheduling area in which they workthe department falls. Should additional hours still be available, insofar as is practical then, in keeping with the needs of the business, and feasible. Such employees shall without disruption to the associate’s own scheduling area, reasonable efforts will be made through the Personnel and Office Supervisor to ensure that non-probationary part time associates from other scheduling areas who have no seniority over apprentices or experienced clerks, nor shall their seniority apply toward experienced clerk's status. (b) An employee on the "available" list may exercise his seniority over other employees submitted requests in accordance with this provision, and who are available and who are qualified to perform the provisions of this Section regardless of whether work in the scheduling area in question, have better opportunities to work, by seniority, such additional hours before temporary associates or probationary part time associates from other employees are on either the "available" or "self-restricted" listscheduling areas. It is understoodunderstood that these provisions shall not have the effect of requiring such associates to be scheduled more than a total of twenty-seven (27) hours per week in non-peak periods, however, that no part-timer can claim the hours from employees who are full-time employees scheduled for nor exceeding forty (40) or more hourshours of work in peak periods, nor creating the payment of overtime. It is also understood that no employee may claim a shift or shifts. (a) An employee on part time associates who have submitted requests in accordance with the "available" list may, within classification, claim a schedule with more hours, except as limited by Section D-3 of this Article, when one becomes available in the store in which said employee is employed, based on seniority rights. Additional Hours. Additional Hours. (a) Seniority Employees in regard the Bargaining Unit who request additional hours in writing shall be offered any available additional hours within their job titles, in their outlet based on their seniority, provided that they have the experience, ability, skill and fitness to claiming a schedule do the job required, and provided the additional hours do not result in overtime and do not conflict with more existing schedules and the existing hours shall apply do not result in the change of status of an employee. The underlying purpose of this is to Clerk's Helpers, Snack Bar reduce the employment of casual employees and Combination Take-Out Bar to regulate the assignment of the hours so displaced to Bargaining Unit employees. An additional purpose is to regulate the assignment of hours due to planned absences of employees within their respective classifications (i.e. vacation, leave without pay, maternity leave, sickness, injury and within the store in long term disability). The term “available additional hours” means hours currently scheduled to be worked on a regular and recurring basis by casual employees, or hours which they work, insofar as is practical and feasiblebecome available due to scheduled absences of Bargaining Unit employees. Such Casual employees shall have no seniority over apprentices or experienced clerksnot normally work in excess of 13 and 1/3rd hours per week except in circumstances where Bargaining Unit employees are not available to work. Part-time Bargaining Unit employees shall be scheduled the longer shift on any particular day where a casual employee is scheduled as well, nor subject to the part-time employee being available and the parties further agree that such scheduling shall their seniority apply toward experienced clerk's status. (6) An employee working overtime must be allowed a rest break of 20 minutes without deduction of pay after each four hours of overtime worked if the employee is to continue work after the rest break. (7) Where a day worker is required to work overtime on a Saturday, Sunday or Public Holiday or on a rostered day off, the first rest break will be paid at the employee's assignment ordinary rate of Department Headspay. (8) Where overtime is to be worked immediately after the completion of ordinary work on a day or shift and the period of overtime is to be more than one and a half hours, third an employee, before starting the overtime is entitled to a rest break of 20 minutes to be paid at ordinary rates. Additional Hours. Employees desiring additional hours of employment shall advise the Employer in writing of their desire of such additional hours. In the event hours become available in a department other than a position to be posted as above, the Employer will offer such hours, up to a normal full-time work schedule as defined in this Agreement to employees in the department who have so requested in order of seniority provided that: 1. Employees who have been reduced in hours during the previous twelve (a12) Seniority in regard months will be offered such hours on a seniority basis, up to claiming a schedule with more their previous number of hours shall apply prior to Clerk's Helpersthe reduction, Snack Bar employees and Combination Take-Out Bar employees within their respective classifications and within provided that those hours are available on the store shift in which they work, insofar as is practical were reduced and feasiblecan all be added to the employee's schedule. 2. Such employees shall have no seniority over apprentices or experienced clerks, nor shall their seniority apply toward experienced clerk's status. Once added to the schedule, if an additional shift assigned to an employee is then removed from the schedule with less than six (6) hours advance notice, the employee shall receive four (4) hours pay at their straight time rate. 5. If it is necessary due to changes in resident census, to reduce or to add to the number of employees scheduled for forty (40) or more hours. It is also understood that no employee may claim to work on a particular shift or shifts. (a) An employee at work on a particular shift, the "available" list may, within classification, claim a schedule with more hours, except as limited by Section D-3 of this Article, when one becomes available in the store in which said employee is employed, based on seniority rights. Except that, when such employee is employed by a Company not having a fixed retail place of business, seniority employer shall be Company-wide within the jurisdiction of the Local Union. When no employee on the "available" list claims a schedule with more hours as set forth above, an employee on the "self-restricted" list may claim such schedule for more hours when one becomes available in the store in which said employee is employed, based on seniority rights. (b) An employee on the "self-restricted" list may exercise his seniority only over other "self-restricted" employees to claim an available schedule with more hours, but may not claim shifts as such and this claim for schedules can only be made after all the employees on the "available" list have exercised their seniority rights to claim such schedules. (a) Within classifications, when a permanent schedule calling for a forty (40) hour workweek on any assignment or shift becomes available in a given store, such work schedule shall be offered first seek volunteers on the basis of seniority and qualifications to an experienced clerk, working less than forty (40) hours, from the "available" seniority list in that storeseniority. If no volunteer is found probationary and temporary employees in the offer is rejected job classification being reduced will be told not to report for any reasonwork or sent home. (b) For the purposes of Article 1 (B)(11)shift due to resident census fluctuations, Article 4 (D)(1)(a), Article 4 (D)(3)(a), Article 6(B)(3, 4 and 6), Article 6 (D)(2 and 4) and Appendix E – G(1) only, Experienced Clerk shall mean a clerk entitled to the thereafter rate of pay for his classification; provided that, it is further understood another shift during that within classifications, if all experienced clerks as so defined, on the "available" seniority list, are working at least forty (40) hours per week, then the forty (40) hour work schedule shall be offered on the basis of seniority to an apprentice on the "available" seniority list who is qualified to do the work and who is working less than forty (40) hours per week. (c) Skills and ability are recognized for the Employer's assignment of Department Heads, third (3rd) person's, and P.I.C.'s (person-in-charge), who shall be designated on the schedule.
