Common use of Agency’s Right to Evaluate Clause in Contracts

Agency’s Right to Evaluate. Agency may, at its sole discretion, conduct evaluations of Consultant’s performance and subconsultant’s performance. Evaluation Criteria. Generally, performance evaluations will include evaluation and scoring of various sub-criteria related to, but are not limited to, the following categories: (a) WOC project management and coordination of staff and subconsultants, (b) project communication and responsiveness, (c) cost effectiveness and completing work within budget, (d) Technical accuracy and quality control, (e) schedule performance. Evaluation Process. The performance evaluation results may be used as written documentation for addressing areas of Consultant’s performance throughout the term of the PA and the term of any WOCs. Agency reserves the right to conduct performance evaluations at the end of each WOC/Project and on an interim basis throughout the term of the PA and the term of any WOCs. Agency may conduct performance evaluations at each major milestone. Deliverables must be submitted on or before the due date and be of acceptable quality (per Agency review) to be considered on time.
