The Artificial Intelligence clause defines how artificial intelligence (AI) technologies may be used, managed, or restricted within the context of the agreement. This clause ensures that both parties understand their rights and obligations regarding AI, helping to mitigate risks associated with automated decision-making and to promote responsible use of emerging technologies.

Artificial Intelligence. The Provider has implemented and is in material compliance with policies and procedures for the ethical, trustworthy, and responsible use, implementation, and provisioning of AI technology, including for: (i) developing, implementing, and provisioning AI Technology in a way that promotes transparency, accountability, safety, security, fairness, accuracy, validity, reliability, and human interpretability; and (ii) identifying and mitigating bias in Training Data and the Services. In addition, the Provider’s management has oversight and approval over its collection and use of Training Data, including the development, implementation, and provisioning of AI Technology. The Provider confirms it is in compliance with all laws applicable to the Provider's development, implementation, and provision of AI Technology.
Artificial Intelligence. 1. The Parties recognise that the use and adoption of Artificial Intelligence (AI) technologies are becoming increasingly important to digital trade, offering significant social and economic benefits to natural persons and enterprises. In view of this, the Parties shall endeavour to cooperate, in accordance with their respective laws and policies, through:
(a) sharing research and industry practices related to AI technologies and their governance;
(b) promoting and sustaining the responsible use and adoption of AI technologies by businesses and across the community; and
(c) encouraging commercialisation opportunities and collaboration between researchers, academics, and industry.
2. The Parties also recognise the importance of developing ethical governance frameworks for the trusted, safe, and responsible use of AI technologies that will help realise the benefits of AI. In view of the cross-border nature of digital trade, the Parties further acknowledge the benefits of ensuring that such frameworks are internationally aligned as far as possible. To this end, the Parties shall endeavour to:
(a) collaborate on and promote the development and adoption of ethical governance frameworks that support the trusted, safe, and responsible use of AI technologies, including through relevant international fora; and
(b) take into consideration internationally-recognised principles or guidelines when developing such frameworks.
Artificial Intelligence. The provision set forth in Exhibit B is added to the CBA as a new Section 61.

Artificial Intelligence. The Subrecipient shall not use State Data in any generative artificial intelligence (“GAI”) queries, training, or program creation without prior written permission from DHHS. The Subrecipient attests that its GAI models use only properly licensed material. The Subrecipient shall fully indemnify and hold DHHS harmless from all claims, loss, or damages related to the Subrecipient’s use of GAI. Should the Subrecipient learn that State Data has been used in GAI queries without DHHS permission, the Subrecipient shall immediately notify DHHS. The Subrecipient shall inform DHHS of any GAI in the Goods or Services being contracted for prior to providing those Goods or Services to DHHS. The Subrecipient shall include annotations sufficient to comply with DTS Policy 4000-0008 (Generative AI Policy) when utilizing GAI in the creation of Goods and Services with the potential to impact DHHS intellectual property rights.

Artificial Intelligence. 1. The Parties recognise that the use and adoption of Artificial Intelligence (AI) technologies have grown increasingly widespread in the digital economy.
2. The Parties recognise the economic and social importance of developing ethical and governance frameworks for the trusted, safe and responsible use of AI technologies. In view of the cross-border nature of the digital economy, the Parties further acknowledge the benefits of developing mutual understanding and ultimately ensuring that such frameworks are internationally aligned, in order to facilitate, as far as possible, the adoption and use of AI technologies across the Parties’ respective jurisdictions.
3. To this end, the Parties shall endeavour to promote the adoption of ethical and governance frameworks that support the trusted, safe and responsible use of AI technologies (AI Governance Frameworks).
