Asbestos Exclusion. Notwithstanding any provision of this policy including any exclusion, exception or extension or other provision which would otherwise override a general exception, this policy does not cover any legal liability, loss, damage, cost or expense whatsoever or any consequential loss directly or indirectly caused by, arising out of, resulting from, in consequence of, in any way involving, or to the extent contributed to by, the hazardous nature of asbestos in whatever form or quantity.
Asbestos Exclusion a. Loss, damage, or remediation expenses caused by or resulting from the presence of asbestos or asbestos-containing materials is excluded. As used in this exclusion, remediation expenses are expenses incurred for or in connection with the investigation, monitoring, removal, increased cost of reconstruction, disposal, treatment, abatement, or neutralization of asbestos or asbestos- containing materials to the extent required by federal, state, or local laws, regulations, or statutes, or any subsequent amendments, to address asbestos.
b. This asbestos exclusion does not apply to the extent that coverage is provided under the following:
1) This Policy insures asbestos located within an insured building or structure, and then only that part of the asbestos which has been physically damaged during the Policy period by a Covered Cause of Loss.
2) This coverage is subject to all limitations in the Policy and, in addition, to each of the following specific conditions to coverage:
a) The said building or structure must be insured under this Policy for damage by this Covered Cause of Loss;
b) The Covered Cause of Loss must be the immediate, sole cause of the damage to the asbestos; and
c) Insurance under this Policy in respect of asbestos shall exclude any sum relating to:
i. Any faults in the design, manufacture, or installation of the asbestos; or
ii. Asbestos not physically damaged by a Covered Cause of Loss, including any governmental or regulatory authority direction or request of whatsoever nature relating to undamaged asbestos.

This Coverage Form does not insure against asbestos material removal or demolition or increased cost of reconstruction, repair, debris removal or loss of use necessitated by the enforcement of any law or ordinance regulating asbestos material or any government direction declaring that asbestos material present in, or part of, or utilized on any portion of the insured “project site” must be removed or modified.

Customer understands and agrees that this agreement does not include the detection, abatement, encapsulation, or removal of asbestos (or any hazardous waste product) or products or materials or equipment containing asbestos. In the event that Southwest mechanical Services encounters any asbestos product or material in the course of performing its work, Southwest Mechanical Services shall have the right to discontinue its work and remove its employees from the work site, or that portion of the work site wherein such product or material was encountered, until such product or materials, and any hazards connected therewith are abated, encapsulated or removed, and/or it is determined that no hazard exists. Southwest mechanical Services may rely upon Customer's representations and warranties regarding asbestos and Customer's compliance with Asbestos Evaluation Requirements. Any other site investigation requirements notwithst ▇▇▇▇▇▇, Southwest Mechanical Services shall have no duty to identify, detect or evaluate asbestos.

This endorsement is applicable to the Public liability section, Employers liability section, Umbrella liability section, Broadform Public liability section, Personal Liability section, Extended personal legal liability section, sub-section D (Liability) of the Buildings combined section, sub- section D: (Property owner's liability) of the Houseowners section and Extensions 17. Tenants liability and 18. Liability to the public of the Householders section of the policy. It is hereby understood and agreed that this Policy shall not apply to, and does not cover, any actual or alleged liability whatsoever for any claim or claims in respect of loss or losses directly or indirectly caused by, arising out of, resulting from, in consequence of, in any way involving, or to the extent contributed to by, the hazardous nature of asbestos in whatever form or quantity.
Asbestos Exclusion. In consideration of the premium paid, the Insurer and the Insured agree that this endorsement amends the following Coverage Parts: Professional Liability Coverage Part The EXCLUSIONS Section, Subsection A. of each Coverage Part shown above is amended to add the following:
Asbestos Exclusion. No indemnity will be provided in respect of any liability arising directly or indirectly from mining, processing, manufacturing, removing, handling, disposing of, treatment of, distributing or storage of asbestos.
