Availability Factor Sample Clauses
The Availability Factor clause defines the percentage of time that a system, equipment, or service must be operational and available for use during a specified period. In practice, this clause sets a benchmark for performance by requiring the provider to maintain uptime above a certain threshold, such as 95% or 99%, often measured monthly or annually. This ensures that the recipient receives reliable service and provides a basis for remedies or penalties if the agreed level of availability is not met, thereby allocating risk and incentivizing consistent performance.
Availability Factor. The summation of the number of days that all apartments are dedicated to the rental pool in the quarter shall be the denominator. The number of days that the particular dedicated apartment is in the rental pool in the quarter shall be the numerator. The resulting fraction, expressed as a decimal, shall be the availability factor for an apartment unit for that calendar quarter.
Availability Factor. The Availability Factor, expressed in hundredths (0.00), for the combined LT Peaking Resource shall be determined each Month as:
(1) the sum of:
(a) the product of:
(i) the then current megawatts (MW) associated with the Remainder
(ii) 0.86
(b) the product of:
(i) the megawatts (MW) purchased by Oglethorpe Power pursuant to the notice incorporated above
(ii) 0.92
(2) divided by the sum of:
(a) the then current megawatts (MW) associated with the Remainder
(b) the megawatts (MW) purchased by Oglethorpe Power pursuant to the notice incorporated above.
Availability Factor. The following Availability Factors shall apply to the following services that are provided on Seller’s Facilities:
(i) Managed Wavelength Services
a) Unprotected – 99.0%
b) Load Shared – 99.99% of the two diverse polls will be available The Availability Factor set forth above shall be measured during each calendar quarter and is a measurement of the percent of total time that Service is operative and deemed available to Buyer in accordance with the above specifications when measured over such period.
Availability Factor. The following Availability Factors shall apply to the following Services that are provided entirely on Seller's Facilities:
(i) E-LAN - 99.0% packet delivery rate The Availability Factors set forth above shall apply for each calendar quarter and is a measurement of the percent of total time that Service is operative and deemed available to Buyer in accordance with the above specifications when measured over such period.
Availability Factor. The following Availability Factors shall apply to the following Services that are provided entirely on Seller’s Facilities:
(i) MPLS IP-VPN - 99.0% packet delivery rate The Availability Factors set forth above shall apply for each calendar quarter and is a measurement of the percent of total time that Service is operative and deemed available to Buyer in accordance with the above specifications when measured over such period.
Availability Factor. The following Availability Factors shall apply to the following Services that are provided entirely on Seller’s Facilities:
(i) DS-1 Service – 99.90%
(ii) DS-3 Service – 99.95%
(iii) OCn Services – 99.99%
Availability Factor. The following Availability Factors shall apply to DIA Services that are provided entirely on Seller’s Facilities:
(i) Port Only – 99.999%
(ii) Port with DS-1 Local Loop Service – 99.90%
(iii) Port with Ethernet Private Line Local Loop Service
i. Unprotected – 99.0%
ii. Protected (Network protection; no client protection) – 99.9%
Availability Factor. The following Availability Factors shall apply to DIA Services that are provided entirely on Seller’s Facilities:
(i) Port Only – 99.999%
(ii) Port with Ethernet Private Line Service - 99.0% The Availability Factors set forth above shall apply for each calendar quarter and is a measurement of the percent of total time that Service is operative and deemed available to Buyer in accordance with the above specifications when measured over such period. The Availability Factor for any other Service will be as agreed to by Seller and Buyer in writing.
Availability Factor. The “Availability Factor” shall be the amount resulting from dividing the number of actual hours the Project is providing Distribution Services in a Delivery Month by the total number of Delivery Hours in that month, as represented by the equation below: AFm DMHm = The number of Delivery Hours in Delivery Month m FMHm = The number of Delivery Hours in which the Project is unavailable to provide Distribution Services due to a Force Majeure event in Delivery Month m.
6.1 Contract Pricing. The payments for Distribution Services are set forth in Appendix IV and described in more detail below.
