Availability of Lists. On or before the bid day posting of each school year, the Association President shall receive in writing a list of all teachers by seniority in each category of certification/licensure. Teachers with certification/licensure in more than one area will be listed in all areas. Continuing contract status and tie-breakers will also be listed.
Availability of Lists. A. A seniority list of all teachers in each area of their certification shall be developed annually by the administration according to the seniority provisions set forth above. The Association President shall receive a copy of the list(s) by January 15th of each year. B. On or before April 5th and preceding the date of implementation, the Association President shall be notified in writing of the Board’s intent to implement a layoff and shall receive in writing: 1. The list of the positions in each teaching field affected by the reduction in teachers. 2. The seniority lists for all teachers based upon their teaching field. 3. The list of teachers whose contracts are to be suspended or non-renewed for other than performance reasons in each teaching field affected. This list shall constitute the Reduction in Force list. C. Following the fulfillment of the requirements in Section 7.096 (B), administrators will be responsible for advising those teachers whose contracts are to be suspended as part of a reduction in force. D. On or before April 20th, and prior to Board action on layoff, a meeting shall be held between representatives of the Association and representatives of the Board of Education to review appropriate data and discuss the layoff. At this meeting the administration shall present formalized lists indicating the specific number of positions to be eliminated within each area of classification, and a list of teachers to be laid off. E. If a dispute occurs with regard to the justification for the layoff, and/or the teachers to be laid off, the matter(s) shall be submitted to expedited arbitration in accordance with the procedures established by the American Arbitration Association.
Availability of Lists. No later than April 1 of each year, the Association President shall receive in writing: (1) The list of the positions in each teaching field affected by the reduction in teachers. (2) The seniority lists for all teachers as defined in Section 3.a., above. (3) The lists of teachers whose contracts are to be suspended in each teaching field affected. This list shall constitute the RIF list.
Availability of Lists. When a reduction in employees is scheduled to take place between September 1 and May 31 of a school year, the Board shall A. President the following list at least thirty (30) calendar days before the effective date of the reduction. When a reduction of employees takes place between June 1 and August 31 of a school year, the Board shall provide the W.E. A. President the following list on or before May 15th. The list, which will be in writing includes: a. The list of positions in each teaching field affected by the reduction of employees. b. The seniority lists with evaluation status for all employees based upon their area(s) of licensure/certification. c. The list of employees whose contracts are to be suspended in each teaching field affected. This list shall constitute the Reduction in Force list.
Availability of Lists. At least fifteen (15) calendar days before the Board action to reduce the number of teachers, the President of the Association shall receive in writing a tentative list of positions in each teaching field affected by the reduction in teachers. The President of the Association will verify the original or revised list prepared by the Superintendent. In addition, as of October 1st of each school year, the Seniority Lists for all teachers as defined in Article 10, Section 1004.1 shall be available for review by the Association.

  • AVAILABILITY OF AGREEMENT The employer must ensure that copies of this Agreement and the NES are available to all employees to whom they apply, such as on a notice board which is conveniently located at or near the workplace or through electronic means, whichever makes them more accessible.

  • Availability of Funds The County may terminate this Agreement or a portion of the services referenced in the Attachments and Exhibits based upon unavailability of Federal, State, or County funds, by providing written notice to Contractor as soon as is reasonably possible after the County learns of said unavailability of outside funding.

  • Non-Availability of Funds The obligation of the RCO to make payments is contingent on the availability of state and federal funds through legislative appropriation and state allotment. If amounts sufficient to fund the grant made under this Agreement are not appropriated to RCO for expenditure for this Agreement in any biennial fiscal period, RCO shall not be obligated to pay any remaining unpaid portion of this grant unless and until the necessary action by the Legislature or the Office of Financial Management occurs. If RCO participation is suspended under this section for a continuous period of one year, RCO’s obligation to provide any future funding under this Agreement shall terminate. Termination of the Agreement under this section is not subject to appeal by the Sponsor.

  • Availability of Funding This Agreement and all claims, suits, or obligations arising under or related to this Agreement are subject to and limited by the receipt and availability of funds which are received from the Participating Entities by NCTCOG dedicated for the purposes of this Agreement.

  • Availability of Utilities All utility services necessary for the construction of the Improvements will be available prior to the commencement of construction, and all utility services necessary for the proper operation of the Improvements for their intended purposes are available at the Leased Premises or will be available at the Leased Premises prior to the Final Disbursement Date, at commercially comparable utility rates and hook-up charges for the vicinity, including water supply, storm and sanitary sewer facilities, gas, electricity and telephone facilities. Lessee shall furnish evidence of such availability of utilities from time to time at Lessor's request.
