Availability of Software. 2.1 The User acknowledges that: a. The User must create an Account to access the Software; b. Atmail is not responsible for verifying the underlying accuracy, truthfulness or completeness of any information provided by the User; c. Atmail’s obligation to comply with all laws applicable to Atmail and the Software overrides Atmail’s obligations to the User; d. Availability of Software. (a) Each Institution hereby permits The University of Miami to act as distributor for the MIDAS software to members of the academic and research community only. Upon request, The University of Miami will provide copies of MIDAS Software to academic and non-profit research and educational Institutions in accordance with the terms of the Material Transfer Agreement attached hereto. The University of Miami will notify each of the principle investigators at the respective institutions on behalf of the institution on a yearly basis of all transfers of MIDAS software, or more frequently at the University of Miami s discretion.

  • Availability of Service We will use reasonable efforts to make the Service available for your use on a continuous basis.   • AVAILABILITY OF AGREEMENT The employer must ensure that copies of this Agreement and the NES are available to all employees to whom they apply, such as on a notice board which is conveniently located at or near the workplace or through electronic means, whichever makes them more accessible.

  • Availability of Records Consultant shall maintain the records supporting this billing for not less than three years following completion of the work under this Agreement. Consultant shall make these records available to authorized personnel of the Town at the Consultant's offices during business hours upon written request of the Town.
