The Baseline Documentation clause establishes the set of documents that serve as the official reference point for a project’s scope, requirements, and standards. Typically, this includes drawings, specifications, and other key documents agreed upon at the outset of a contract, which are used to measure progress and assess compliance throughout the project. By clearly identifying these baseline documents, the clause ensures all parties have a common understanding of the project’s expectations and deliverables, thereby minimizing disputes and providing a clear benchmark for evaluating changes or resolving disagreements.
Baseline Documentation. The condition of the green infrastructure is documented in a Baseline Report at the office of the District and incorporated into this Covenant by reference. The Baseline Report consists of reports, maps, photographs, and other documentation and provides an inventory of relevant features, characteristics, and conservation values. The Baseline Report provides an accurate representation of the condition of the green infrastructure at the time of the conveyance of this Covenant. The Baseline Report is an objective, but not exclusive, reference for monitoring compliance with the terms of this Covenant.
Baseline Documentation. The conservation values, various use areas and the current use, size, location and condition of improvements of the Property are described in a Baseline Documentation Report (the Report ). Grantor and Grantee have copies of the Report, and acknowledge that the Report is accurate as of the date of this Easement. The Report may be used by Grantee to establish that a change in the use or character of the Property has occurred, but the report shall not preclude the use by Grantee of other evidence to establish the condition of the Property as of the date of this Easement.
Baseline Documentation. The Current Conditions (which may or may not include restoration and enhancement efforts pursuant to compensatory mitigation activities), of the Property as of the date of this Deed are further documented in a "Present Conditions Report," dated, , 20 and prepared by [ preparer’s name ], which report is acknowledged as accurate by ▇▇▇▇▇▇▇ and ▇▇▇▇▇▇▇. The present conditions report includes: (a) a current aerial photograph of the Protected Property at an appropriate scale taken as close as possible to the date the donation is made; (b) on-site photographs taken at appropriate locations on the Protected Property, including of major natural features; and, (c) a surveyed plat of the Protected Property showing all relevant property lines, all existing man-made structures, improvements, features, and major, distinct natural features such as waters of the United States, and shall be recorded in the RMC office for each county in which the Protected Property is situated prior to the recording of this Conservation Easement, and is recorded at [insert book and page references, county and date of recording] (d) [etc. - insert any additional documentation which may be used to evidence the natural condition of the ` Protected Property] The Present Conditions Report has been provided to both parties and will be used by Grantee to assure that any future changes in the use of the Property will be consistent with the terms of this Deed. However, the Present Conditions Report is not intended to preclude the use of other evidence to establish the condition of the Property as of the date of this Deed.
Baseline Documentation. Buyer shall prepare baseline documentation adequately documenting the condition of the Property at the date of closing. Seller shall have an opportunity to review and comment on the baseline documentation. The cost of the baseline documentation shall be borne by Buyer. If the form of conservation easement provides for use of a management plan, the management plan shall be prepared as a part of the baseline documentation and the cost therefor absorbed in the same manner the cost of the baseline documentation is absorbed.
Baseline Documentation. The set of documents that consists of photographs, maps, surveys and supporting text that the Grantor and Grantee mutually agree describes the general condition of the Easement Property, documents the location of buildings, improvements, and driveways on the Easement Property, and defines the boundaries of the Designated Use Areas (hereinafter defined) of the Easement Property.
Baseline Documentation. The Baseline Documentation, executed by Grantee and Grantor and by this reference incorporated herein, is on file with the Grantee and may be used by Grantee to establish whether or not a change in the use or character of the Easement Property has occurred.
Baseline Documentation. The parties have gathered sufficient documentation to assess and establish the current condition and uses of the Property and to inventory its human and natural features, a summary of which is contained within the Baseline Documentation report, which report is incorporated herein. The parties acknowledge that the current and proposed allowed future conditions and uses of the Property are compatible and do not conflict with the purposes, terms, conditions and restrictions within this Easement. The parties thus acknowledge that the Baseline Documentation presents an accurate representation of the condition and features of the Property as of date hereof, and that the Baseline Documentation: 1. verifies the existence of the Conservation Values 2. serves as a primary resource for the Town to recognize changes taking place on the Property 3. serves as a guide for monitoring the activities on, and conditions of, the Property 4. serves as a means for determining compliance with the terms and provisions of this Easement Accordingly, the parties acknowledge and agree that should any controversy arise regarding the nature and extent of Landowner’s activities upon or uses of the Property, the impairment of any Conservation Values, or the physical condition of the Property upon the date hereof, the Baseline Documentation is and shall be deemed relevant to the resolution of any such controversy.
Baseline Documentation. Documentation describing the property needs to be compiled for each conservation easement that LRCT accepts, in order to provide a baseline for future monitoring of the property. In addition, where a charitable deduction is claimed for a donated conservation easement, a record of the property's condition at the time of easement conveyance is required to satisfy IRS regulations. While this is an obligation of the landowner claiming the tax deduction, ordinarily LRCT prepares the baseline documentation for review and confirmation by the landowner.
Baseline Documentation. A Baseline Documentation Report providing specific ecological characteristics of the Conservation Easement was prepared pursuant to Treas. Reg. § 1.170A-14(g) (5) and establishes the baseline condition of the Property at the time of the grant of this Conservation Easement (Exhibit E). The Baseline Documentation includes maps, depictions of existing buildings and other human-made modifications, identification of flora and fauna, land use history, distinct natural features, and photographs. The Baseline Documentation Report is intended to serve as an accurate representation of the Property at the time of this conveyance. The Baseline Documentation Report is also an objective baseline that will be used for monitoring purposes and to assure that any future change in the use of the Property will be consistent with the terms of this Conservation Easement. However, this Baseline Documentation Report is not intended to preclude the use of other evidence to establish the present condition of the Property if there is a controversy over its use.
Baseline Documentation. The current condition of the Property is documented in the Grant Agreement. an inventory of relevant features of the Property, dated , 200 , on file at the offices of Grantee (the “Baseline Documentation”). The parties agree that the Baseline Documentation provides an accurate representation and description of the Property at the time of this grant. The Baseline Documentation is intended to serve as an objective, although not exclusive, information baseline for monitoring compliance with the terms of this Easement. Grantee shall have the right to access the Property at any time for the purpose of monitoring compliance with the terms of this Easement.
