Common use of Break Between Shifts Clause in Contracts

Break Between Shifts. Employees are entitled to a break of at least 10 hours between shifts that commence on 2 consecutive days. Only under exceptional circumstances and by mutual agreement with the employee will such a break be less than 10 hours. Those hours that are within the 10 hour break during the second shift will be paid at the applicable overtime rate.

Those hours that are within is not given then the 10 hour break during first 4 hours of the second employee’s next shift will shall be paid at double the applicable overtime ratehourly rate in the case of current employees and at a 20% loading in the case of new employees. This rule does not apply to more than one shift worked on the same day.
