Common use of Breaking of Seniority Clause in Contracts

Breaking of Seniority. A layoff and time spent on disability, retirement, or any Board- approved leave of absence shall not be construed to constitute a break in seniority; however, an employee's seniority shall be broken upon resignation, permanent retirement, or discharge in accordance with the provisions of this Agreement. In the event that two or more employees in the same area of certification/licensure share the same seniority by first day worked, they shall be placed on the seniority list in accordance with Board action. If a tie still exists, the employees shall be placed on the seniority list in accordance with the date of their application for employment with the Board.
