The 'Card Not Present Transactions' clause defines the rules and responsibilities for processing payment transactions where the physical payment card is not presented, such as online or phone purchases. Card Not Present Transactions. If you use the 16-digit Card number without presenting the Card in person (such as for a mail order, telephone, or internet purchase), the legal effect will be the same as if you used the Card itself. For security reasons, we may limit the amount or number of such transactions you may make. You may not use the Card for illegal gambling or any other illegal transaction.
Card Not Present Transactions. If you initiate a transaction without presenting your Card (such as for a mail order, internet or telephone purchase), the legal effect will be the same as if you used the Card itself. For security reasons, the amount or number of such transactions you may make may be limited.
Card Not Present Transactions. 9.2.1 Undertaking Card Not Present Transactions will be solely at Your risk and You will be liable for any Losses which occur as a result of undertaking such Transactions. You understand and accepts this.
9.2.2 If You wish to accept Transactions using more than one URL, You must agree with Us first. You will not use more than one URL to accept Transactions, register more than one URL or use a URL to accept Transactions under the Payment Terms which is not the URL agreed and notified to Us as being related to these Payment Terms.
9.2.3 We may immediately, on giving You notice, withdraw Our permission for You to accept or process certain types of Card Not Present Transactions where there are, in Our sole opinion, unacceptable levels of Cardholder disputes resulting from such Card Not Present Transactions which You have accepted and/or Card Not Present Transactions which You have accepted and which subsequently turn out to be fraudulent.
Card Not Present Transactions. For card-based Transactions in which the card is not present, AGENCY must obtain and include as part of the Authorization request the three
Card Not Present Transactions. The following additional requirements apply to Card-Not-Present Transactions:
a. All Card-Not-Present Transactions are at Sub-Merchant’s risk. As to each Card-Not-Present Transaction, Sub-Merchant warrants to WorkWave that the person whose name is submitted as the Cardholder either made, or authorized another to make, the purchase. Upon breach of this warranty, WorkWave may charge back the Payment Card Processing Transaction to Sub-Merchant. If WorkWave charges back the Payment Card Processing Transaction to Sub-Merchant, Sub-Merchant will pay WorkWave the amount of the Payment Card Processing Transaction, a Chargeback fee, and any Association fines or assessments. WorkWave may charge the Payment Card Processing Transaction to the Operating Account or any Reserve without prior notice to Sub-Merchant.
b. All Card-Not-Present Transactions must be electronically authorized and, in addition to the information required for documenting Card-Present Transactions, also will indicate: an Authorization code, if required; customer address and address verification; card verification value (CVV); card identification data (CID); and in lieu of the Cardholder’s signature, a notation of (1) mail order, (2) telephone order, (3) e-commerce order, or (4) pre-authorized order, on the signature line.
c. If Sub-Merchant accepts a Pre-Authorized Recurring Order Transaction, the Cardholder will execute and deliver to Sub- Merchant a written request for this pre-authorization. This written request will be maintained by Sub-Merchant and made available upon request to WorkWave. All annual ▇▇▇▇▇▇▇▇ must be reaffirmed at least once per year. Sub-Merchant will not deliver goods or perform services covered by a Pre-Authorized Recurring Order Transaction after receiving notification from the Cardholder that the pre-authorization is cancelled, or after receiving notification from WorkWave that the Card covering the Pre-Authorized Recurring Order Transaction is not to be honored.
d. For telephone or mail order sales, Sub-Merchant will transmit a ticket/invoice number and will verify the Cardholder’s billing address with the applicable Issuer, CVV, and CID, and will only accept as approved those Payment Card Processing Transactions receiving at least a partial match or system unavailable response.
Card Not Present Transactions. If you use your Card without presenting it to the merchant in person (such as for a mail order, telephone, or Internet purchase), the legal effect will be the same as if you presented the Card to the merchant in person.

For security reasons, the amount or number of such transactions you may make may be limited. Authorization Holds. When you use your Card to purchase goods or services or to make a cash back withdrawal transaction, the merchant may request a preauthorization for the transaction. If the merchant makes such a request and there are sufficient available funds in your Account, we will approve the transaction and a “hold” is placed on your Account for the amount of the preauthorization request (which may vary in some cases from the amount of the actual purchase, depending on the merchant or purchase type), until the merchant sends the final payment amount of your purchase, or for up to thirty (30) days, even if you fail to make the purchase, to the extent permitted by applicable law. The merchant controls the timing of both the Card authorization and settlement of the transaction. During the hold period, you may not have access to the preauthorized amount in your Account. We will not be responsible if any transactions are not completed because of the hold. If the preauthorization request varies from the amount of the actual transaction, the actual transaction amount will be debited from your Account, even if this results in your Account balance becoming negative. You remain responsible for any negative balances in your Account. If the Card is declined, but you have sufficient funds available in your Account for which the Card was issued, you should use the Card to pay for the purchase inside with the cashier. You do not have the right to stop payment on any purchase or payment transaction originated by use of the Card once an authorization is approved.
Card Not Present Transactions. Whenever a buyer uses a debit or credit card as the payment method for a transaction using their account to buy something from you as a seller, the transaction will be processed as a “card not present” transaction, even if the buyer is at your store location.
Card Not Present Transactions. 8.1 You understand that Card Not Present Transactions carry a greater risk of rejection by Cardholders, and refusals and Chargebacks by us, because the Transaction is conducted without you, the Cardholder and the Card all being present in the same location.
8.2 You may not accept Internet Transactions without our prior written approval. If we have agreed to process Internet Transactions for you, the requirements set out in Schedule C apply.
8.3 You may obtain permission from a Cardholder to periodically bill that Cardholder's Credit Card for a Recurring Transaction where that is permitted by a Payment Card Network, and in accordance with the applicable Payment Card Network Rules.
Card Not Present Transactions. For a Card Not Present Transaction you must give the Cardholder a Transaction Receipt described in clause 14(i) above as soon as it is reasonably possible after one is requested by the Cardholder. You must:
a) obtain Transaction authorisation within the seven days prior to the dispatch of goods to be shipped to your Customer and the ▇ ▇ ▇ es Transaction should be processed on the date of shipping;
b) contact the Customer to request permission to obtain a subsequent Trans ac t ion authorisation if more than seven days have elapsed between the date of the original Transaction authorisation and the goods being shipped;
c) where the transaction is initiated by telephone, you must give the Cardholder the following information at the time of the transaction:
(i) a receipt number; and
(ii) the Transaction amount (including the amount of any surcharge); and
(iii) the type of Transaction (e.g. sales or refund); and
(iv) Merchant’s trading name; and
d) provide the Bank with details of your practices to minimise fraud and chargebacks immediately on request and comply with practices to minimise fraud and chargebacks which are acceptable to the Bank. You agree that where the Bank or any of the approved Card Schemes consider it appropriate to investigate fraud or chargebacks, the Bank may defer crediting your Nominated Account with the amount of sales Transactions in accordance with Clause 17, pending the outcome of that investigation.
