Compensatory Time Bank. Employees, at their option, may accumulate up to ninety-six (96) hours of compensatory time. Time will accumulate at the rate of one and one- half (1½) hours for each hour worked. Upon separation from service for any reason, members shall be paid at the employee’s current rate of pay for all accumulated hours of time. The parties agree that for the purposes of this Agreement, any request for the use of compensatory time that would result in fewer than one (1) employee in this bargaining unit to be working on a shift will result in a denial of the request for compensatory time, as it constitutes an undue hardship. Additionally, the parties agree that should a special circumstance exist, in the discretion of the Chief of Police, requiring more employees in this bargaining unit to be on shift, requests for compensatory time may be denied as constituting an undue hardship. Neither the employee nor the FOP-OLC shall be able to grieve a denial of compensatory time regarding either of the conditions found in this paragraph. Upon request, and approval by the Chief or the Chief’s designee, compensatory time may be taken in one (1) hour segments or more. When a member dies while in paid status in the City service, any unused compensatory time to the member’s credit shall be paid in a lump sum to the surviving spouse or the estate of the deceased.
