CONDUCT GUIDELINES. ERW strives to promote health and wellness in a safe and pleasant environment for all staff and clients. While every scenario is not covered in the following conduct guidelines, all clients are expected to conduct themselves in a manner which is conducive to the safety and respect of others. The following actions/behaviors are strictly prohibited and may result in termination of membership privileges: ● Harassment or intimidation verbally or by physical actions, body language, or any type of inappropriate behaviorPhysical contact with another person in a non-consensual, aggressive, or threatening way ● Verbally abusive behavior, including angry or vulgar language, demeaning comments or raising your voice at another individual ● Sexually explicit conversation or behavior; any sexual contact with another person ● Inappropriate, immodest, or sexually revealing attire ● Closed toe shoes must be worn in the fitness area ● Possession of a weapon of any type ● Possession, use or being under the influence of alcohol or illegal chemicals while on ▇▇▇▇▇ Rehabilitation & Wellness premises. ● Smoking while on ERW Personal Training premises ● Inappropriate use of cell phones in the fitness area ● Use of any video/picture taking equipment, including camera phones, in the fitness center area ● Theft or destruction of property ● Solicitation or loitering on ERW Personal Training property ● Children under the age of 14 are not permitted in the gym. Children 14-15 years old must be accompanied by a parent or guardian at all times ● You must be 18 or older to obtain a single membership ● Non-member guests/family members are not allowed to wait on you in the facility during your workout without written authorization by ERW Personal Training Administrative staff. ● No food or drink is allowed in the facility with the exception of water and sports drinks in a closed, unbreakable, spill proof container. ● Allowing a non-member to accompany you in the work out area may result in loss of your membership privileges. Please be aware that our gym/clinic staff may at times provide unsolicited suggestions on modifying your exercise form and or parameters. Automated billing of monthly dues will not be halted for any reason other than medically related issues that prohibit participation in exercise. CONDUCT GUIDELINES. The Board may adopt guidelines that will be binding on all directors in the performance of their duties. The guidelines may deal with conflicts of interest, the circumstances in which directors should disqualify themselves from voting or participating in a Board decision, matters of confidentiality and such other matters as the Board deems appropriate. Prior to adopting any such guidelines, the Board will provide the Industry Advisory Committee with a reasonable opportunity to comment.

CONDUCT GUIDELINES. The rights granted to you under this Agreement are subject to the following conduct guidelines concerning the Services (as applicable): • You will not copy, reproduce, distribute, transmit, republish, post, publicly perform or publicly display the Services, or any information or content made available on or through the Services, without NFMA’s prior written consent; • You will not modify or create derivative works of the Services; • You will not remove or destroy any copyright notices or other proprietary markings contained on or in any portion of the Services; • You will not access or use the Services to build a similar or competitive service or application; • You will not reverse engineer, decompile, disassemble, re-engineer or otherwise create or attempt to create or permit, allow, or assist others to create the source code of the Services or their structural framework; • You will not sublicense, subcontract, translate, license or grant any rights to the Services (including without limitation allowing any distribution or sublicense of the Services or other access to the Services by any person or entity); • You will not use any robot, spider, site search or retrieval mechanism or other manual or automatic device or process to retrieve, index, data mine, or in any way reproduce or circumvent the navigational structure or presentation of the Services; • You will not create Internet “links” to the Services or “frame” or “mirror” any content therein; • You will not harvest or collect information about or from other users of the Services, including from the Member Directory published in our Member Portal; • You will not probe, scan or test the vulnerability of the Services, or breach the security or authentication measures on the Services, or take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Services; • You will not upload invalid data, viruses, worms, keyloggers, spyware, Trojan horses, time bombs, malicious or harmful code, or other software agents through the Services; • You will not attempt to gain unauthorized access to the Services or their related systems or networks; and • You will not use the Services in whole or in part for any illegal purpose. HotSpot Parking will not be liable for any damages caused by virtue of the compromise of your account or password, including any unauthorized access to your account, use of your password or compromise of your credit card details. Please contact HotSpot Parking immediately if you suspect or become aware of any unauthorized use of your user name or password or any other breach of security; and HotSpot Parking reserves the right to terminate your access to the HotSpot Parking Service and take appropriate legal action if you are in breach of these requirements or any other terms of this Agreement.

Please contact Feonix immediately if you suspect or become aware of any unauthorized use of your user name or password or any other breach of security; d. not share your account or allow anyone else to use your account. e. not authorize third parties to use your account, and you may not allow persons under the age of 18 to receive rides ordered through the Service unless they are accompanied by you; f. not smoke or consume alcoholic beverages while receiving a ride ordered through the Service; g. not cause nuisance, annoyance, inconvenience, or property damage, whether to the Providers or other users; and h. provide proof of identity to any Provider who requests such proof, and you agree that you may be denied access or use of the Services if you refuse to provide proof of identity. i. not manipulate or abuse the service(s) by no-showing or canceling trips close to the departure time. Excess no-shows or cancellations may result in a temporary booking limitation being placed on your account. j. Feonix reserves the right to terminate your access to the Service and take appropriate legal action if you are in breach of these requirements or the restrictions in Section 10 Use Restrictions below.
