Content License. If Merchant has provided Yiftee photos, images, text, data, or other materials or content (collectively, "Content"), Merchant hereby grants Yiftee a royalty-free, nonexclusive, worldwide, license to display, reproduce, distribute, modify, prepare derivative works of, perform, and otherwise use and exploit all Content in connection with the promotion and marketing of the Gifts and the Services as long as this agreement is in effect.

A Party transferring Internet Content shall promptly notify the Party receiving the Internet Content if it discovers any mistakes, omissions, errors, viruses, or other defects in the Internet Content and will promptly inform the receiving Party of: (i) the date of discovery; (ii) the method of transmission or causation; and (iii) the corrective action taken by the transferring Party.
Content License. If the User makes any User Content available to other Users and/or the COMPANY by distributing it while using the Platform, including through live streaming, the User shall grant to the COMPANY and its affiliates a non-exclusive, global, permanent, irrevocable, transferable, gratuitous, sublicensable, limited license to use such User Content by any lawful means, in particular for the reproduction, distribution, transfer, transcoding, translation, broadcasting, public display, public perfomance, publication, modification and creation of such User Content. This license shall be deemed granted to COMPANY for the entire duration of the intellectual property rights in such User Content as soon as it is distributed on the Platform or as of the COMPANY otherwise acquiring such rights, in particular, from its affiliates. The Platform may provide Users with the opportunity to post User Content, which will be publicly available to all Internet Users or to all users of the Platform or a specific Service. In using the Platform, the User understands and agrees that by uploading User Content to the Platform, the User is granting access thereto to the said persons by default. The User accepts that the Company has the right to use the functional and technical capabilities of the Platform, including the video-player of the Service “VK Play Live”, that enable the display of User Content published by the User, at its own discretion, including to show advertising information. The User understands and agrees that the User Content published by a User on the Platform, including the User Content created using the User’s image, may be displayed via the video-player of the Service “VK Play Live” without access restrictions, and that the functional capabilities of the Platform may allow the third parties to display the video-player of the Service “VK Play Live” on their resources using video embedding, inline frames and other similar technologies. Other than in the cases established by the Agreement or applicable Russian Federation law, no User Content may be copied (reproduced), processed, distributed, represented, published, downloaded, transferred, sold, or otherwise used in whole or in part without the prior consent of the COMPANY or the respective rightsholder, except in cases where the rightsholder has clearly expressed their consent to the free use of the User Content.
