Credit Request Clause Samples

Credit Request. To the extent that Loans are made in accordance with clause (b) of Section 2.3, any Drawer requests that the Fronting Bank create an Acceptance, or any Borrower requests that the Fronting Bank issue a Letter of Credit other than by means of notification in accordance with the terms of the Tradexpress Agreement, the Administrative Agent shall have been presented with a draft by any Drawer or shall have received a Borrowing Request or Issuance Request, as the case may be, for such Credit Extension, executed and delivered (as applicable) by the applicable Borrower. Each of the delivery (or deemed delivery pursuant to the terms of this Agreement) of a draft by any Drawer, a Borrowing Request or an Issuance Request and the creation of the Acceptance, the acceptance by any Borrower of the proceeds of the Borrowing, the issuance of the Letter of Credit, or the making of a Loan upon a Disbursement or the maturity of an unreimbursed Acceptance, as applicable, shall constitute a representation and warranty by such Borrowers that on the date of such Credit Extension (both immediately before and after giving effect to such Credit Extension and the application of the proceeds thereof) or the creation of an Acceptance or the issuance of the Letter of Credit, as applicable, the statements made in Section 6.2.1 are in each case true and correct.

Credit Request. With respect to each Extension of Credit, the Administrative Agent shall have received a Credit Request, executed by a duly authorized officer of the Borrower.

Credit Request. The Lender shall have received a Borrowing Request or Issuance Request, as the case may be, for such Credit Extension. Each of the delivery of a Borrowing Request or an Issuance Request and the acceptance by the Borrower of the proceeds of the Borrowing or the issuance of the Letter of Credit as applicable, shall constitute a representation and warranty by the Borrower that on the date of such Borrowing (both immediately before and after giving effect to such Borrowing and the application of the proceeds thereof) or the issuance of the Letter of Credit, as applicable, the statements made in SECTION 6.3.1 are true and correct.

Credit Request. The Administrative Agent shall have received a Borrowing Request or Issuance Request, as the case may be, for such Revolving Credit Extension. Each of the delivery of a Borrowing Request or an Issuance Request and the acceptance by the applicable Revolving Credit Borrower of the proceeds of the Borrowing or the issuance of the Revolving Credit Letter of Credit, as applicable, shall constitute a representation and warranty by each Revolving Credit Borrower that on the date of such Borrowing (both immediately before and after giving effect to such Borrowing and the application of the proceeds thereof) or the issuance of the Revolving Credit Letter of Credit, as applicable, the statements made in Section 6.2.1 are true and correct.

Credit Request. The Agent shall have received the related Borrowing Request or Issuance Request, as the case may be, for such Credit Extension, which Borrowing Request or Issuance Request will include a statement that all conditions to such Borrowing have been met. Each of the delivery of a Borrowing Request or an Issuance Request and the acceptance by any Borrower of the proceeds of the Borrowing or the issuance of the Letter of Credit, as applicable, shall constitute a representation and warranty by the Borrowers that on the date of such Borrowing (both immediately before and after giving effect to such Borrowing and the application of the proceeds thereof) or the issuance of the Letter of Credit, as applicable, the statements made in Section 6.2.1 are true and correct.

Credit Request. In order to receive a credit under this Service Level Agreement, you must request it by emailing Radar at ▇▇▇▇▇▇▇@▇▇▇▇▇.▇▇ within ten days of the end of the applicable month. If you submit a credit request and do not receive a prompt automated response indicating that the request was received, you must resubmit the request because the submission was not properly received and will not result in a credit. Customers who are past due or in default with respect to any payment or any material contractual obligations to Radar are not eligible for any credit under this Service Level Agreement. Radar shall calculate any service level downtime using Radar’s system logs and other records. Service credits will be applied on your next Radar invoice following Radar’s receipt of your request for credit and Radar’s verification that the Service Level was not met.

Credit Request. To receive Service Credits, you will need to submit a claim by submitting a case to our Support, including the report on how Your service or processes was affected by the downtime of Our Services. To be eligible, the credit request must be received by Us within ten (10) business days after which the incident occurred. In order to be entitled to a Service Credit, respective claims must be made within ten (10) business days after the alleged service interruption or non-Availability. Such requests must be made in good faith and include details about the respective time and duration of the service interruption and how it affected You.

Credit Request. A student requesting transfer credit from another approved FAA Part 147 School or applicable aviation experience must submit official documentation (i.e., official transcripts, military experience, DD214 or training records at the time of enrollment up through the tenth official day of the block. If the documentation for Advanced Standing cannot be produced during this time period, the student may enroll at a future date to ensure any possible credits are applied.
