Discretionary Practices. (a) Full details in writing are set out in the Disclosure Letter of all discretionary practices under each Pension Scheme which is a Defined Benefit Scheme and each Phi Scheme and the current terms applicable on early retirement, late retirement, commutation, optional dependant’s pension and other optional arrangements under each Pension Scheme. (b) Save as disclosed in such written details in respect of each Pension Scheme or PHI Scheme, no power or discretion has been exercised and no intention to so exercise has been communicated: (i) to admit to membership any employee or officer who would not otherwise have been eligible for membership; or (ii) to pay a contribution which would not otherwise have been paid or to augment or provide in respect of any past or present employee or officer of the Irish Companies or dependant or beneficiary of any such person a benefit which would not otherwise have been paid.
Discretionary Practices. Both parties acknowledge that certain discretionary practices exist within the employer/employee relationship, which do not have a material effect on the conditions of employment, such as staff recognition celebrations. The parties agree that such practices shall continue to exist at the sole discretion of the City.
Discretionary Practices. So far as the Sellers are aware, the Data Room contains full and accurate details of the discretionary benefits and increases provided to the Networks Members and Transferring Members under the E.ON UK Group, as defined in Schedule 10, and a full and accurate description of the basis upon which they are provided in the E.ON UK Group.

  • Unfair Labor Practices The Grantee shall comply with the Employers Engaging in Unfair Labor Practices Act, 1980 PA 278, as amended, MCL 423.321 et seq.
