Displacement Rights After Layoff. Employees with seniority who are laid off shall be entitled to displace an employee in another job classification to which the employee had been previously assigned to on other than a temporary basis or a probationary employee in another job classification under the following conditions: (a) The laid off employee has greater seniority than the employee to be displaced. (b) The laid off employee presently has the necessary qualifications, skill, and ability to perform the work in the other job classification. (c) The laid off employee elects to exercise their displacement rights within five (5) working days of notification of their layoff. An employee displaced under this Section shall be laid off unless that employee is also entitled to exercise displacement rights under this Section. An employee exercising displacement rights under this Section retains the right of recall to their former classification.
