Electronic messages Clause Samples

The 'Electronic messages' clause defines the rules and conditions under which electronic communications, such as emails or other digital transmissions, are recognized and accepted between the parties to an agreement. Typically, this clause specifies what constitutes a valid electronic message, how such messages are to be delivered, and when they are considered received—often including provisions for delivery to designated email addresses or through secure platforms. Its core practical function is to ensure clarity and legal certainty regarding the use of electronic communications, reducing disputes about whether notices or information have been properly sent and received.
Electronic messages. For the purposes of each Relevant Document, the conditions relating to sending and receiving information in electronic form are those in the Contract and Commercial Law Act 2017 (and any other applicable law from time to time). Where you or a Guarantor has given us an electronic message address, that person consents (unless otherwise requested in writing) to receiving information (including, but not limited to, information required by law) in electronic form, by means of an electronic communication, and signed by means of an electronic signature. This may include receiving electronic messages allowing access to statements from a website or by means of the internet.
Electronic messages. You acknowledge that data, including emails, may be accessed by unauthorized third parties when communicated between you and the Bank, using the Internet (for example, by such third party downloading spyware or malware onto your computer), telephone, or other electronic devices.
