End User Terms. Customer hereby agrees to the terms set forth at ▇▇▇▇://▇▇▇.▇▇▇▇▇▇▇▇▇▇▇.▇▇▇/verizon- ▇▇▇▇.html, which may be enforced by RingCentral, Inc. as a party hereto. In the case of any direct inconsistency between the End User Terms and the Agreement, the Agreement takes precedence.

Intellectual Property Rights Means all trade secrets, patents and patent applications, trademarks and service marks (whether registered or unregistered and including any goodwill acquired in such trademarks and service marks), trade names, business names, internet domain names, e-mail address names, copyrights (including rights in computer software, object code and source code), moral rights, database rights, design rights, rights in know- how, rights in confidential information, rights in inventions (whether patentable or not) and all other intellectual property and proprietary rights (whether registered or unregistered, and any application for the foregoing), and all other equivalent or similar rights which may subsist anywhere in the world. Intelligence Report A report which is commissioned by the Client into an aspect of its staffing needs or staffing challenges, or an aspect of the job market as a whole.

This may require you to (a) notify each end user that Digital Samba products are subject to the Digital Samba Customer Agreement and that by placing an order with Reseller the end user agrees to the Digital Samba Customer Agreement, (b) include either a copy of or link to the Digital Samba Customer Agreement in each quotation and order form you issue to the end user, and (c) obtain from each end user written confirmation of acceptance of the Digital Samba Customer Agreement prior to the earlier to occur of acceptance of the order by Reseller or delivery of the Product. You must provide evidence of such acceptance by the end user to Digital Samba upon request.

Rightsholder The person or organisation that enters into this Agreement and is named as the “Rightsholder” in the Account, together with its permitted successors and assigns. Services The services set out in clause 3 and any additional services taken up by the Rightsholder from time to time by signing or accepting a Supplementary Schedule for those Services, all of which are provided by CLNZ under this Agreement. Supplementary Schedule A set of terms outlined in a Supplementary Schedule Template that is agreed or accepted by the Rightsholder and sets out the details for additions to this Agreement. User An employee or contractor of the Rightsholder who has Access Privileges (including each Authorised Person). Work/s A literary work (including an artistic work included in the literary work, and separately specified typographical arrangements of published editions of the literary work), or an artistic work, under the Act, for which there is a Work Listing, and each part of that Work. The Rightsholder lodges Rights Confirmations for Work/s via MyCopyright Work Listing The completed webform on MyCopyright which sets out the details of a Work, Payee(s), and other details, for which a Rights Confirmation has been lodged by a User.
