Engineering Charges. 21.1 The Seller reserves the right to charge the Buyer for engineering charges and expenses (whether internal or to third parties) incurred by the Seller in relation to the design or manufacture of the goods, such to include (without limitation) design costs and the cost of tools. Such charges and expenses shall be payable by the Buyer in addition to the purchase price for the goods. 21.2 The Seller shall remain the owner of tools and designs and all copyright and other rights relating thereto whether or not such charges are paid by the Buyer.
Engineering Charges. MFGR will amortize non-recoverable engineering ("NRE") costs to the price of the Product when implementing one time engineering changes. The amortization schedule, dollar amount to be amortized and the number of units of Product over which NRE cost will be amortized shall be mutually agreed by CUSTOMER and MFGR. Upon agreement of the parties, MFGR shall adjust the price to the formula provided in Exhibit A, and then add on the NRE amortization.
Engineering Charges. Engineering charges are based on the engineering time required to design a product to the Purchaser's requirements. Payment of the engineering charges does not constitute ownership of a particular design. Since many designs incorporate proprietary or patented techniques, processes, etc. the Seller is normally the only manufacturer capable of producing the design.
Engineering Charges. When the work embraced in the contract is not completed on or before the date specified, engineering and inspection expenses incurred by the Agency upon the work, from the completion date originally fixed in the Contract to the actual date of completion of the work may be charged to the Contractor and may be deducted by the Agency from the final monies due the Contractor. Consideration of any extra work or order on contract added to the original contract amount, as well as extenuating circumstances beyond the control of the Contractor, will be given due consideration by the Agency before assessing engineering and inspection charges against the Contractor. Such charges will be assessed however, in cases where the work has been unduly delayed by the Contractor without acceptable reasons, or due to inefficient operations, or any other reason for which the Agency determines the Contractor liable.
