Feasibility of Performance Clause Samples

Feasibility of Performance. The Consultant (i) has carefully examined and analyzed the provisions and requirements of this Agreement, including all Exhibits hereto; (ii) understands the nature of the Services required; (iii) from its own analysis has satisfied itself, to the extent reasonably possible, as to the nature of all things needed for the performance of this Agreement and all other matters that in any way may affect this Agreement or its performance; (iv) represents that this Agreement is feasible of performance in accordance with all of its provisions and requirements; and (v) can and will perform, or cause to be performed, the Services in accordance with the provisions and requirements of this Agreement.
Feasibility of Performance. As of the Effective Date, Design-Builder has evaluated the feasibility of performing the Work within the Completion Deadlines specified in the Contract Documents and for the Contract Price. Design-Builder represents that it is feasible to perform the Work within those cost and time constraints. Upon completion of the Scope Validation Period, Design-Builder represents that it is feasible to perform the Work for the Contract Price and within the Completion Deadlines, accounting for any adjustment to the Contract Price and Completion Deadlines resulting from the Scope Validation.
Feasibility of Performance. The Contractor has evaluated the feasibility of performing the Work within the time specified herein and for the Contract Price, and has reasonable grounds for believing and does believe that such performance by the applicable Completion Deadlines and for the Contract Price is feasible and practicable.
Feasibility of Performance. As of the effective date of each Pricing Package Amendment, the Progressive Contractor has evaluated the constraints affecting delivery of the Project and has reasonable grounds for believing and does believe that the Project can be designed and built within such constraints and has reasonable grounds for believing and does believe that performance of the Work is feasible and practicable. As of the effective date of each Pricing Package Amendment, the Progressive Contractor: (a) has evaluated the constraints affecting design and construction of the Project, as well as the conditions of the NEPA Approval, and has reasonable grounds for believing and does believe that the Project can be designed and built within such constraints; (b) has conducted a reasonable investigation and otherwise examined the Site as well as surrounding locations, and as a result of such review, inspection, examination, and other activities the Progressive Contractor is familiar with, and has satisfied itself as to, the character of the Site, and accepts the physical requirements of the Work, subject only to the Progressive Contractor’s express rights and bases to seek relief under this Agreement; and (c) has evaluated the feasibility of performing all Work under the Pricing Package Amendment within the time and for the amount set forth therein, accounting for constraints affecting the Project and has reasonable grounds for believing and does believe that such performance (including achievement of all Completion Deadlines for the Pricing Package GMP) is feasible and practicable.

Related to Feasibility of Performance

  • Continuity of Performance In the event of a dispute between the Party and the State, each party will continue to perform its obligations under this Agreement during the resolution of the dispute until this Agreement is terminated in accordance with its terms.

  • Review of Performance The Board of Directors shall periodically review and evaluate the performance of Employee under this Employment Agreement with Employee.

  • Commencement of Performance This Agreement is of no force and effect until signed by both parties and all JBE-required approvals are secured. Any commencement of performance prior to Agreement approval shall be at Contractor's own risk.

  • Manner of Performance Subject to the provisions of Article XII hereof, the Contractor shall perform all of the Work described in the Statement of Work, or cause such Work to be performed in an efficient and expeditious manner and in accordance with all of the terms and provisions of this Agreement. The Contractor shall perform the Work in accordance with the current professional standards and with the diligence and skill expected for the performance of work of the type described in the Statement of Work. The Contractor shall furnish such personnel and shall procure such materials, machinery, supplies, tools, equipment and other items as may reasonably be necessary or appropriate to perform the Work in accordance with this Agreement.
