Guidance Memorandum. A. By September 30, 2023, the District will create for OCR review and approval a memorandum for distribution to administrators and staff (classified and non-classified) that provides guidance and information about the requirement imposed on the District by both Section 504 and Title II to administer all of its services, programs, and activities for its students with disabilities in the most integrated setting appropriate to their needs and of their (administrators and staff) obligation to comply with this mandate. The memo will also explain that the most integrated setting is one that enables students with disabilities to interact with students without disabilities to the fullest extent possible and that the District is required to modify its policies, practices, and procedures to avoid discriminating on the basis of disability, unless such modifications would fundamentally alter the nature of a service, program, or activity. The memorandum will provide information on how to properly ensure that students with disabilities are being fully integrated into the District’s services, programs, and activities, including information about the individualized nature of the integration process and that integration determinations can only be made by individuals with sufficient knowledge of the student, the student’s disability, and the manifestations of the disability and that, at times, the determination may need to be made by the student’s Section 504 team or individualized education program (IEP) team. Likewise, the memorandum will also discuss the prohibition on basing an integration process and determination on stereotypes, assumptions, and speculation associated with students who have disabilities. The memorandum will also emphasize that failing to fully integrate a student with a disability with his or her peers who do not have disabilities results in the impermissible segregation of the student and is disability discrimination. Additionally, the memorandum will give examples of school situations in which the integration obligation applies and the steps that need to be taken to ensure that it has been followed, including the presentation by the Student’s grade that was the subject of this complaint (the memo may use fictitious references/names so as not to single out the specific event at the Student’s school or the Student’s school itself). Guidance Memorandum a. The District will issue a guidance memorandum to all District employees responsible for securing counseling service to remind them of the District’s obligations and procedures to provide these services in full.

By January 12, 2023, the District will create for OCR review and approval a memorandum that reaffirms the District’s adherence to the nondiscrimination principles, including the prohibition against retaliation, provided for by Section 504 and Title II and that also states and explains the District’s Uniform Complaint Procedures (UCP) as the complaint process to be used by those who believe that discrimination has occurred. At a minimum, the memorandum will include information on the following: 1) the general nondiscrimination requirement found in 34 C.F.R. § 104.4 and 28 C.F.R. § 35.130;
Guidance Memorandum a. By April 30, 2021, the District will issue a guidance memorandum to all District employees with a reminder concerning District procedures used to process reports or complaints of retaliation and discrimination on the basis of disability, to whom such reports or complaints should be forwarded for further action, and applicable Board Policies and Administrative Regulations concerning such reports or complaints.
Guidance Memorandum. A. By December 1, 2018, the District will create for OCR review and approval a memorandum that is addressed to relevant District administrators, faculty, and staff that provides guidance and information about providing home instruction to students with disabilities. The memorandum will, at a minimum, include: information discussing the requirement that every determination regarding instruction to be provided to a student with a disability must be made on an individualized basis in compliance with the procedural requirements of Section 504 related to educational setting, evaluation, placement, and receipt of services; when providing home instruction to a student with a disability constitutes a significant change in placement and the obligations triggered by the change in placement; the differences and distinctions between providing home instruction to a student with a disability and the home/hospital instruction program; and, the nonapplication of the various limitations and restrictions on the instruction provided by the home/hospital instruction program to students with disabilities and the requirement to provide them with a FAPE. B. Within fifteen (15) days of OCR’s approval of the memorandum required by the previous paragraph, the District will disseminate the memorandum to its administrators, faculty, and staff. Dissemination may be done through electronic means (e-mail), placement in internal mail boxes/in boxes, mailing through the U.S. Postal Service, or any combination of these methods that is designed to reach the maximum number of recipients possible. In addition to disseminating a copy of the memorandum to relevant administrators, faculty, and staff, the District will post the memorandum to its website in a conspicuous location and at all District locations at which other similar District documents are posted in order to inform faculty, staff, students, parents, or the public of such information. The memorandum will remain posted at these locations for a minimum of one year.
Guidance Memorandum. A. The Library will submit to OCR a draft memorandum that provides guidance (guidance memorandum) regarding the Library’s Grievance Procedures and Complaint Form.

The memorandum will address issues such as: the District’s obligations pursuant to the Title II service animal regulations; how the District’s general policy on animals relates to service animals; the topics addressed by Title II’s service animal regulations; and, application of the District’s obligations and Title II when the District agrees to permit third parties to use its facilities for their events and activities. B. Within fifteen (15) days of OCR’s approval of the memorandum required by section (II)(A), the District will disseminate the memorandum in accordance with the requirements of section (II)(A). Dissemination may be done through electronic means (e-mail), placement in internal mailboxes/in boxes, mailing through the U.S. Postal Service, or any combination of these methods that is designed to reach the maximum number of recipients possible. The District will also send a copy of the memorandum to the administrative offices of XXXXXXXX X, the providers of the event that was the subject of this complaint, along with a letter, memo, note, or other item that informs XXXXXXXX X of the reasons the District is sending the memorandum.
Guidance Memorandum. A. The District will distribute a guidance memorandum to all District administrators and School staff, including campus supervisors and counselors, that includes the following: 1. An explanation of the District’s obligation to comply with Title VI and its implementing regulations; 2. The definition and examples of racial discrimination and harassment, as well as the District’s policy prohibiting racial discrimination and harassment (including a reference to the District’s anti-harassment statement in Section I.B. above); 3. A statement that the District is responsible under Title VI for responding appropriately to reports of harassment based on race, color, or national origin, even if a written complaint is not filed; 4. An explanation of the steps School administrators, supervisors, and staff (including teachers and counselors) should follow if they learn of discriminatory harassment based on race, color or national origin (from School staff, parents, or students); 5. A description of the District’s policy for processing, investigating and resolving discrimination and/or harassment complaints based on race, color or national origin, including a reference as to where individuals may locate a copy of the full policy; and 6. The name of the individual(s), by name or title, and contact information, responsible for compiling, receiving, and investigating reports of harassment and/or discrimination based on race, color or national origin.
Guidance Memorandum. A. The District will develop written guidance for District staff in the Office of the Superintendent, Educational Services and Innovative Programs, and Human Resources division, as well as all School1 staff and administrators, regarding the process for responding to allegations of discrimination made by District employees, including those referred to the District’s Career Resource Department (CRD) and employed by agencies with which the District has an agreement or Memorandum of Understanding.
