HOURS OF WORK, OVERTIME AND SHIFT PREMIUM. 8.01 Although the seasonal demands of customers make a regular workweek throughout the year impossible, it is the desire of the Union and the Employer to provide hours of work which will give satisfactory annual earnings to the employees. Due to the irregular nature of the workday and the workweek employees may be required to work in excess of eight (8) hours per day and forty-eight (48) hours per week. 8.02 The Employer shall offer available work for drivers as follows: a. The Employer shall, each day, create a daily start time list (the “List”) at each plant and determine what number of drivers to include on the List based on the work anticipated to occur the following day. The Employer shall assign start times to the drivers on the List in accordance with each driver’s seniority, and, pursuant to Article 8.04 – Equalization of Hours, in accordance with the total number of hours a driver has worked that week. b. Drivers will be responsible to call in each day between 7:00 p.m. and 6:00 a.m. to find out if they have been assigned a start time on that workday’s List. c. Drivers may waive their daily start time and be “slotted” in for a later time in the day subject to the following: i. The employee must submit such request before noon on the workday prior of the day that they request to waive their start/call in time. The request shall be in writing on a form provided by Employer; ii. Such requests shall be granted if in connection to an employee’s family care responsibilities, the need to attend to a medical appointment, a medical condition, or some other reason that the Employer considers reasonable; iii. Such requests may be made for a particular day, or on a standing basis. d. If additional work opportunities arise at a plant during the course of a day and as a result the Employer requires more drivers than those on the List for that plant, the Employer shall call in additional drivers in accordance with their seniority, subject to the following order of call-in: i. Active drivers with seniority at the plant from which the work is to be assigned, who were not assigned a start time on the List; ii. Drivers from other plants, provided such drivers were on the List at their own plant that day, who are reasonably available to perform the work and do not deprive active drivers from the plant at which the work is to be assigned of hours; iii. Drivers on layoff at the plant from which the work is to be assigned, who are available for call-in, in accordance with Article 8.04; iv. Drivers on layoff from plants that are closed (see LOA #7), and thereafter drivers on layoff from other plants, beginning with the drivers from the plant within closest proximity; v. Drivers on layoff from other plants, beginning with the plant in closest proximity to the plant at which the work is to be assigned. For the purposes of this Article, the term “active driver” excludes drivers that have been given a layoff in accordance with Article 11. e. For drivers who are not on the List and who are called in during the day, the following shall apply: i. Upon being called, a driver will be allowed a reasonable amount of time to report for work. In most cases, this will be around one (1) hour with the understanding that some drivers will be able to report sooner and some drivers, because of distance, will take longer. Start and load times of these drivers will depend on customer needs and the arrival time of drivers. ii. A driver who is called, but does not immediately answer, will be left a message and be given a reasonable amount of time to return the call (plus or minus 5 minutes), depending on customer needs. iii. A driver must be available for work until 10:00 a.m. Employees who do not wish to be called that day may check in with dispatch that morning to determine if that is permissible. iv. The Employer will endeavour to call drivers by 10:00 a. m. for work that becomes, or is anticipated to become available that day. Employees that are contacted before 10:00 a.m. for work that will not begin before 12:00 p.m. may elect not to work that day. f. In situations where a customer or particular job requires a specific truck, and in consideration of the practice that drivers are generally assigned the same truck each day, the Employer may assign the most senior driver normally assigned to the type of truck required. g. After all available drivers have been provided the opportunity to work, employees from other classifications may be assigned to drive a ready mix truck. 8.03 A driver that is temporarily laid off may indicate their desire to be available for call-in by using a form provided by the Employer. An occasional offer to work shall not constitute a recall from layoff. If the driver is unavailable, or refuses three

If the driver is unavailable, or refuses threethree (3) successive opportunities to work while laid off, he shall not be called in for a period of one (1) month, after which, the driver may again request to be available for call-in. This provision shall not interfere with the employee’s responsibility to return to work in a timely fashion after recall from layoff, in accordance with Article 11.08.
