Common use of Incidence Clause in Contracts

Incidence. 3.1 This Agreement shall apply to the same parties as the Port Waratah Coal Services Limited Enterprise Agreement 2005. 3.2 This Agreement shall be read in conjunction with the "PWCS Limited Enterprise Agreement 2005" as varied from time to time and shall have precedence over it. 3.3 Any disputes arising out of the operation of these rostering arrangements shall be progressed in accordance with the Disputes Settlement Procedure of the PWCS Limited Enterprise Agreement 2005. 3.4 This Agreement shall operate from the (Date of Certification) It is intended that this 10 Hour Daywork Roster shall operate for a period commensurate with the initial term of the PWCS Limited Enterprise Agreement 2005 applicable to PWCS-▇▇▇▇▇▇▇▇▇▇ and PWCS-Kooragang. In the event that circumstances circumvent the implementation/continuation of the rosters contained in this Agreement, discussion will take place between the parties prior to the alteration of this roster. 3.5 The parties to this Agreement may seek to vary or terminate this Agreement by not less than seven (7) days notice in accordance with clause 19 (a) (iv) of the "PWCS Limited Enterprise Agreement 2005".
