Common use of Incidence Clause in Contracts

Incidence. 3.1 This Agreement shall apply to Port Waratah Coal Services Limited as to the employment of, or persons coming within the scope of the conditions of eligibility for membership rule of the Unions party to this Agreement in or in connection with the Company’s operations at Newcastle. 3.2 This Agreement shall be read in conjunction with the "Port Waratah Coal Services Limited Enterprise Agreement 2005 as varied from time to time.
