Is retired. If an employee’s seniority is broken and the employee is subsequently hired to work in the Police Department, seniority shall run from the most recent date of hire within the bargaining unit.
Is retired. Employees who promote to a position outside of the bargaining unit and return within one (1) year of the date of promotion shall have no breaks in their seniority. However, if an employee is promoted out of the bargaining unit returns after one (1) year from the date the employee leaves the bargaining unit, the employee’s seniority will be frozen at the employee’s time within the bargaining unit. In the event an employee is laid off involuntarily, the employee shall have seniority frozen, but not broken. In the event an employee is laid off voluntarily, the employee shall continue to accrue seniority.

If the employee is absent from work due to an on-the-job injury or illness for a period in excess of three years from their original date of injury/illness or another event occurs to extinguish reinstatement rights in accordance with ORS 659A.043 and ORS 659A.046. (It is however understood and agreed that the seniority of an employee who is continuously absent due to an on-the-job injury or illness will be frozen after one year.)
