Kill Fee Sample Clauses

Kill Fee. In the event the Work is not published in any format within two years of author’s signature date of this Agreement as a result of the Publisher’s actions, decisions, or omissions, a kill fee in the amount of 30% of the payment for rights defined in Sections 1a, 1b, and 1c of this Agreement will be paid to the Author (the “Kill Fee”) unless the Author has already received payment equal to the amount defined in Section 2 of this Agreement. In the event the Work is not published through no fault of the Publisher, then the Kill Fee shall not be due. In the event that the Kill Fee is owed, this Agreement shall terminate upon payment of the Kill Fee, and the grant of rights in and to the Work shall terminate.

Kill Fee. Publisher shall pay a kill fee in an amount as agreed upon between Publisher and Freelancer if Publisher terminates the Project without cause after Publisher and Freelancer agree on a project.

Kill Fee. We will pay you a kill fee of fifty percent (50%) of the Production Fee for a Work that is killed after significant work has begun but prior to completion. The kill fee for a completed Work is one hundred percent (100%). After a kill fee is paid, all rights revert to you.

Kill Fee. Client acknowledges that Designer has reserved time to perform the Services for each month, and Designer was not able to accept other work for that month. Accordingly, in the event Client cancels or delays the Services, Client shall pay to Designer, in addition to the retainer and expenses already incurred through the date of such cancellation or delay, a kill fee equal to a pro rata portion of the retainer amount for the period ending thirty (30) days following the date of termination , unless Designer is able to secure new work for that time for the same or greater compensation.

Kill Fee. 15.1 If the Writer delivers a manuscript that fails to meet the requirements of the assignment and if the Publication considers that the manuscript cannot be made acceptable through rewriting, the Editor may terminate the assignment by providing the Writer with written notice and paying the Writer not less than one half of the agreed fee, plus the Writer’s expenses to date, in which case all rights to the manuscript shall revert to the Writer. 15.2 If the Editor requests a rewrite that requires the Writer to express opinions that are not the Writer’s own, to include information that, in the opinion of the Writer, will falsify or distort the story, or to write a substantially different manuscript, the Writer may withdraw the manuscript and terminate the assignment. In this case, the Publication will pay the Writer no less than one half of the agreed fee plus his or her expenses to date, in which case all rights to the manuscript shall revert to the Writer. 15.3 If, in the course of research or during the writing of a manuscript, the Writer concludes that the information available will not result in a satisfactory story, the Writer will inform the Editor and give reasons to discontinue the assignment. If the Editor agrees, the assignment is terminated. The Publication will pay a fee, to be negotiated, to compensate the Writer for work done prior to termination, on presentation of the Writer’s research documentation. 15.4 If the Writer or Editor wish to cancel this agreement after work has begun, the Publication will pay a fee, to be negotiated, to compensate the Writer for work done prior to cancellation.

Kill Fee. In the event Client desires to terminate this Agreement prior to receipt of the Final Payment, in addition to any other amount owed hereunder at the time, a "Kill Fee" will be assessed on Client. The "Kill Fee" will be set in the Proposal, if the Proposal is silent on the Kill Fee, the Kill Fee will be set by default at 10% of the remaining project costs.

Kill Fee. If the Project or Architect’s services are terminated by the Client prior to completion, the Architect will be entitled to a kill fee constituting the amount of the project retainer. In this case, the retainer will not be deducted from the final project invoice. If the Project is terminated during the completion of an Architectural phase, the full phase will be billed, or the sum of hourly staff time invested on the phase to date will be billed at Standard Hourly Rates, whichever is lesser.

Kill Fee. Where a bargaining unit non-VICE payrolled employee employed by VICE to produce video for distribution on the VICE Media, LLC owned and operated digital verticals enters into a written agreement to perform work for a specific project to be broadcast on Viceland, the Company shall provide one (1) weeks’ notice, or pay in lieu thereof, if the project is cancelled prior to its scheduled or anticipated end date or publication date. If the written agreement is for less than one (1) week of work and more than (1) day, the Company shall pay out 25% of the unpaid amount of the agreed upon rate.
