Loss of Seniority for a Regular Employee Sample Clauses
Loss of Seniority for a Regular Employee. A regular employee shall lose their seniority in the event that:
(a) They are discharged for just cause.
(b) They voluntarily terminate their employment or abandon their position.
(c) They accept a position with the Employer which is outside the bargaining unit, except for temporary appointments for less than 45 working days. This period may be extended by mutual agreement between the parties. During this period an employee will continue to pay union dues at their old rate and remain a member of the bargaining unit.
(d) They accept severance pay in accordance with Article 13.
Loss of Seniority for a Regular Employee. A regular employee shall lose his/her seniority with the Employer in the event he/she:
(a) is discharged for cause;
(b) resigns his/her position;
(c) is on layoff for more than one (1) year;
(d) accepts a position with the Employer which is outside the bargaining unit, except for temporary appointments of less than four (4) consecutive months;
(e) accepts a severance payment in accordance with Article 13;
(f) refuses, while on layoff, an offer from the Employer of a regular position that he/she is qualified for in his/her seniority block;
(g) Declines while on layoff, three (3) offers of temporary work provided such employee has made a written election to accept auxiliary work during his/her layoff.
Loss of Seniority for a Regular Employee. (a) A regular employee shall lose his/her seniority in the event that:
(1) he is discharged for cause;
(2) he resigns or abandons his/her position;
(3) accepts a position with the Employer which is outside the bargaining unit, except for temporary appointments for less than forty-five (45) working days. This period may be extended by mutual agreement between the Parties. During this period an employee will continue to pay Union dues at his/her old rate and remain a member of the bargaining unit;
(4) accepts a severance payment in accordance with Article 13;
(5) performs no work for the Employer for a period of twelve (12) consecutive months from the last date of work.
(b) A regular employee on leave of absence without pay, other than leave of absence for an elected or appointed position in the Union, or leave granted under Article 21, shall not accrue seniority for leave periods over thirty (30) calendar days.
(c) A regular employee on a claim recognized by the Workers' Compensation Board or ICBC shall be credited with service seniority equivalent to what he would have earned had he not been absent and had been able to work.

(2) he resigns or abandons his/her position;

(c) accepts a position with the Employer which is outside the bargaining unit, except for temporary appointments for less than a forty-five (45) working days. This temporary period may be extended by mutual agreement between the parties. During this temporary period an employee will continue to pay union dues at his/her old rate and remain a member of the bargaining unit;
(d) accepts a severance payment in accordance with Article 13;
(e) laid off for more than eighteen (18) months.
(f) is sent notice of recall by double registered mail to the last address on record with the Company and fails to report within fifteen (15) days of receipt of notice, unless he has contacted the company and has received an extension to report. A notice of recall which has been returned as unclaimed or refused will be considered received. n the event of a disruption of mail service, the Company and Union agree to meet to discuss alternate methods of recall.
(g) if absent due to temporary illness or a non-occupational accident beyond the two (2) year period of time where an employee commenced LTD.
Loss of Seniority for a Regular Employee. (a) A regular employee shall lose their seniority with the Employer in the event that:
(1) they are discharged for cause;
(2) they resign their position;
(3) accepts a position with the Employer which is outside the bargaining unit, except for temporary appointments for less than forty-five (45) working days. This period may be extended by mutual agreement between the parties. During this period an employee will continue to pay union dues at their old rate and remain a member of the bargaining unit;
(4) accepts a severance payment in accordance with Article 13;
(5) refuses a regular position with the Employer while on layoff within the seniority block from which they were laid off;
(6) declines while on layoff three (3) offers of temporary work assignments of three (3) consecutive months' or more;
(7) is on layoff for more than eighteen (18) months'.
(b) A regular employee on a claim recognized by the Workers' Compensation Board or ICBC for on-the-job injury shall be credited with service seniority to what they would have earned had they not been absent and been able to work.

(a) is discharged for cause;
(b) is subject to Clause 11.5, he voluntarily terminates his employment or abandons his position; or
(c) is on layoff for more than one (1) year;
(d) accepts a position with the Employer which is outside the bargaining unit, except for temporary appointments for less than forty-five (45) working days. This temporary period may be extended by mutual agreement between the parties. During this temporary period an employee will continue to pay union dues at his/her old rate and remain a member of the bargaining unit;
(e) accepts a severance payment in accordance with Article 13;
(f) if absent due to temporary illness or a non-occupational accident beyond the two (2) year period of time where an employee commenced Long-Term Disability.

(g) decline, while on layoff, three written offers of a temporary work assignment of less than four months, provided such employee has made a written election to accept auxiliary work during their layoff.
