Major Modification. When the Commission is a party to the development agreement, any party to the development agreement may petition to amend the development agreement. The Participating Parties may petition to rescind the development agreement; the Commission may petition to rescind the development agreement only in the event of failure of consideration. Such petition shall be made in writing and shall state, in specific detail, the petitioner’s reasons for amendment or rescission. The petitioning party shall provide notice to all parties to the development agreement When the Commission is not a party to the development agreement, any other party to the development agreement may petition the municipality or Lead Community to amend or rescind the development agreement. Major Modification. Except as may otherwise be permitted in Section 2.2 for minor modifications, there shall be no change, amendment, revision or modification of or to the Township Zoning Plan for all or any portion of the Annexation Parcel unless the legislative authorities of both Parties mutually consent in writing to the same.
Major Modification. A “Major Modification” is defined as a modification that does not meet the definition of a Minor Modification. TENANT shall proceed as follows for any Major Modification: (i) TENANT must apply to make a Major Modification by submitting an application form to LANDLORD. Should TENANT require an expansion of the Equipment Area, such expansion will be subject to the terms, conditions, procedures and potential rent increases herein. The expansion area will be determined by dimensions of proposed added equipment as well as any additional usable and marketable encumbered space (i.e. spark area) that renders ground space not useable or marketable (additional encumbered space over the current encumbered space provided such additional space would have been usable or marketable should TENANT not have a need for it) . All improvement made by the TENANT to the Licensed Premises shall be in accordance with the construction requirements set forth on Exhibit “E”, which are incorporated herein by reference.   • Waiver; Modification Failure to insist upon strict compliance with any of the terms, covenants, or conditions hereof shall not be deemed a waiver of such term, covenant, or condition, nor shall any waiver or relinquishment of, or failure to insist upon strict compliance with, any right or power hereunder at any one or more times be deemed a waiver or relinquishment of such right or power at any other time or times. This Agreement shall not be modified in any respect except by a writing executed by each party hereto.

  • Waiver or Modification Any waiver, modification, or amendment of any provision of this Agreement shall be effective only if in writing in a document that specifically refers to this Agreement and such document is signed by the parties hereto.

  • Cost Modifications The parties may agree to a reduction in the cost of the Contract at any time during which the Contract is in effect. Without intending to impose a limitation on the nature of the reduction, the reduction may be to hourly, staffing or unit costs, the total cost of the Contract or the reduction may take such other form as the State deems to be necessary or appropriate.

  • Merger & Modification This Contract constitutes the entire agreement between the parties. No understandings, agreements, or representations, oral or written, not specified within this Contract will be valid provisions of this Contract. This Contract may not be modified, supplemented, or amended, except by written agreement signed by all necessary parties.

  • Waiver, Modification, Etc No provision or term of this Amendment may be modified, altered, waived, discharged or terminated orally, but only by an instrument in writing executed by the party against whom such modification, alteration, waiver, discharge or termination is sought to be enforced.
