Minimum Use. Employees must use a minimum of forty (40) hours of vacation per year. Any exception to this section must be approved by the City Manager to be eligible for vacation buyback.
Minimum Use. Annual leave shall be used in amounts of not less than one (1) hour.
Minimum Use. Each employee shall take not less than one third of the leave accrued during the period beginning with the first day of the first pay period in January and ending with the last day of the pay period occurring fifty-two weeks later. An employee shall be exempt from the minimum use requirement to the extent that such use would cause the employee’s personal leave balance to be less than 348 hours (for 24/48 hour regular duty shifts) or thirty days (for 37.5 hour workweeks). Cash in and transfer of leave is not counted towards minimum leave use.

With respect to the use of the Operations Area, if the Parties are not able to resolve the location and use of the Access Rights, the Parties agree that the use of the Access Rights for the Operations Area shall be allocated as depicted in the map attached hereto as a part of EXHIBIT “D”. With respect to the Tailings Area, the Access Rights on the Tailings Area shall be exclusive to EMMR except that KEM shall have access to the Tailings Area as reasonably necessary for the construction and use of the Project related facilities as described in EXHIBIT “E” attached hereto and subject to KEM’s reserved rights as specified in the Mining Agreement with respect to the fine tailings as defined is the Mining Agreement.
