Minor Variations. The Developer shall not vary the Works nor make any additional connections not shown on the Drawings without first obtaining ▇▇▇ ▇▇▇▇▇▇▇▇▇▇'▇ written consent.
Minor Variations. Construction Manager, with the prior written approval of the Project Manager, may authorize minor variations in the Contractor(s)’s work from the requirements of the Contractor(s)’s contract documents that do not involve an adjustment in the Contractor(s)’s contract price or the Contractor(s)’s contract time or design and which are consistent with the overall intent of the Project’s design. The Construction Manager must provide to the Design Team and the Project Manager copies of these written waivers to the Contractor(s). The Construction Manager’s indemnity obligations as indicated herein are applicable to all unforeseen costs and/or schedule impacts to the Project that result from the Construction Manager’s authorization(s) made pursuant to this subsection.
Minor Variations. The Developer may approve Minor Variations in the size, design, engineering, configuration and siting of the Building Improvements, with prior written notice to the Owner, but without obtaining the Owner’s prior written consent.
Minor Variations. 11.1 During the MUP process, DPD may approve applications that vary in minor ways from the requirements of this Agreement. A minor variation is one that: (a) is consistent with the intent of this Agreement to achieve high-quality transit-oriented development near the Station; (b) will not result in significantly greater impacts than are allowed by this Agreement; and (c) will provide at least as much open space, amenity area, and Affordable Housing and Affordable Units as would a project that does not vary from the requirements of this Agreement. A minor variation may not approve greater height than is authorized by this Agreement.
11.2 A structure that is no more than 12 inches less than a stated minimum dimension shall be deemed consistent with this Agreement, and such lesser dimension shall not be subject to review during the MUP process and shall not require a minor variation.
Minor Variations. In addition, the requirements of the Contract Documents may be supplemented and minor variations or deviations in the Work which do not involve an adjustment in the Contract Price or the Contract Time and are compatible with the design concept of the completed Contract Work as a functioning whole, may be authorized in one or more of the following ways:
(1) a field order by the City Engineer;
(2) the City Engineer's approval of shop drawings in accordance with Item 105.3 of the Standard Specifications,
(3) the City Engineer's written interpretation or clarification.
Minor Variations. 10.1 ARENA may, by written notice,
(a) direct a Minor Variation; or
(b) agree to a written request for a Minor Variation by the Recipient, which must set out the details of the proposed variation and the impact the proposed variation will have on the Activity.
10.2 ARENA must act reasonably in:
(a) directing a Minor Variation; and
(b) considering the Recipient's request under clause 10.1(b), with written reasons to be provided if the request is rejected.
10.3 For the avoidance of doubt, variations that are not Minor Variations must be made in accordance with clause 9.
