Motion for Preliminary Approval of Settlement and of Notices. The Court shall have approved the preliminary motion to be filed by Plaintiffs on or before August 3, 2017 (“Preliminary Motion”) by issuing an order in substantially the same form as attached hereto as Exhibit 1 (the “Preliminary Approval Order”), including the class notice approved by the Court (the “Class Notice”): (a) Preliminarily approving this Settlement Agreement; (b) Directing the time and manner of the Class Notice; and (c) Finding that: (i) the proposed form of Class Notice fairly and adequately: (A) describes the terms and effect of this Settlement Agreement and of the Settlement, (B) gives notice to the Settlement Class of the time and place of the hearing of the motion for final approval of this Settlement Agreement, and (C) describes how the recipients of the Class Notice may object to approval of this Settlement Agreement; and (ii) the proposed manner of communicating the Class Notice to the members of the Settlement Class is the best notice practicable under the circumstances.
Motion for Preliminary Approval of Settlement and of Notices. The Court shall have approved the Motion for entry of the Preliminary Approval Order that Plaintiffs file by issuing the Preliminary Approval Order.
Motion for Preliminary Approval of Settlement and of Notices. The Court shall have approved the preliminary motion to be filed by Plaintiffs on or before September 1, 2017 (“Preliminary Motion”) by issuing an order in substantially the same form as that attached hereto as Exhibit 1 (the “Preliminary Approval Order”), including the class notice approved by the Court (the “Class Notice”):
Motion for Preliminary Approval of Settlement and of Notices. The Court shall have approved the preliminary motion for approval of the Settlement, to be filed by Plaintiffs on or before April 16, 2021 (“Preliminary Motion”), by issuing an order (the “Preliminary Approval Order”), including the class notice approved by the Court (the “Class Notice”): (a) Preliminarily approving this Settlement Agreement; (b) Directing the time and manner of the Class Notice; and (c) Finding that: (i) the proposed form of Class Notice is easily understandable, taking into account any special concerns about the education level or language needs of the class members, and fairly and adequately: (A) describes the terms and effect of this Settlement Agreement and of the Settlement, (B) gives notice to the Settlement Class of the time and place of the hearing of the motion for final approval of this Settlement Agreement, (C) describes how the recipients of the Class Notice may object to approval of this Settlement Agreement and clearly advises class members of the deadline for submission of any objections, and (D) provides (1) contact information for class counsel to answer questions, (2) the address for a website, maintained by class counsel, that has links to the notice, motions for approval and for attorneys’ fees and any other important documents in the case, and (3) instructions on how to access the case docket via PACER or in person at any of the Court’s locations; and (ii) the proposed manner of communicating the Class Notice to the members of the Settlement Class is the best notice practicable under the circumstances.
Motion for Preliminary Approval of Settlement and of Notices. Within twenty- one (21) days after the Agreement Execution Date, Named Plaintiffs will file a motion (“Preliminary Motion”) with the Court for an order in the form annexed hereto as Exhibit 1, including the exhibits thereto (the “Preliminary Approval Order”). Named Plaintiffs shall give Defendants at least three (3) days to review the Preliminary Motion before filing.
Motion for Preliminary Approval of Settlement and of Notices. As soon as reasonably possible upon the full execution of this Settlement Agreement by the Settling Parties, and by January 15, 2006, Named Plaintiffs will file a motion (“Preliminary Motion”) with the Court for an order substantially in the form annexed hereto as Exhibit A (the “Preliminary Approval Order”);
Motion for Preliminary Approval of Settlement and of Notices. Class Counsel will file a motion (“Preliminary Motion”) with the Court for an order, the terms of which shall be agreed upon by the Parties, including the exhibits thereto (the “Preliminary Approval Order”), and in good faith shall take reasonable steps to (i) secure expeditious Court entry of the Preliminary Approval Order; and (ii) seek a setting for the Fairness Hearing, described in Section 2.1.4, forty-five (45) days from the mailing of the Class Notice in accordance with Section 2.1.2.
Motion for Preliminary Approval of Settlement and of Notices. The Court shall have approved Plaintiffs’ Motion for Preliminary Approval of Settlement (“Preliminary Approval Motion”), which Class Counsel anticipates filing on or before July 12, 2019, by issuing an order (the “Preliminary Approval Order”), including the Class Notice approved by the Court (the “Class Notice”), and the Claim Form approved by the Court: 2.2.1. a Preliminarily approving this Settlement Agreement; 2.2.1. b Directing the time and manner of the communication of the Class Notice; and 2.2.1. c Finding that: (i) the proposed form of Class Notice fairly and adequately: (A) describes the terms and effect of this Settlement Agreement and of the Settlement, (B) gives notice to the Settlement Class of the time and place of the hearing of the motion for final approval of this Settlement Agreement, and (C) describes how the recipients of the Class Notice may object to approval of this Settlement Agreement; and (ii) the proposed manner of communicating the Class Notice to the members of the Settlement Class is the best notice practicable under the circumstances. 2.2.1. d Approving the Plan of Allocation. 2.2.1. e Approving the proposed Claim Form.

  • PRELIMINARY APPROVAL OF SETTLEMENT Promptly upon execution of this Stipulation, Lead Plaintiffs will move for preliminary approval of the Settlement, certification of the Settlement Class for settlement purposes only, and the scheduling of a hearing for consideration of final approval of the Settlement, which motion shall be unopposed by Defendants. Concurrently with the motion for preliminary approval, Lead Plaintiffs shall apply to the Court for, and Defendants shall agree to, entry of the Preliminary Approval Order, substantially in the form attached hereto as Exhibit A.

  • MOTION FOR PRELIMINARY APPROVAL The Parties agree to jointly prepare and file a motion for preliminary approval (“Motion for Preliminary Approval”) that complies with the Court’s current checklist for Preliminary Approvals.

  • PROCEDURE FOR APPROVAL OF SETTLEMENT Acceptance of this Settlement Agreement shall be sought at a hearing of the Central Regional Council of the MFDA on a date agreed to by counsel for Staff and the Respondent.
