Network User to notify Distributor of changes affecting security: The Network User will immediately notify the Distributor if any of the following occurs: (a) the Network User no longer carries an acceptable credit rating; or (b) the Network User has complied with prudential requirements by arranging for a third party to provide security in accordance with clause 1.1(c), and the Network User learns that the third party no longer carries an acceptable credit rating; or (c) the Network User has reasonable cause to believe that its financial position is likely to be materially adversely impaired such that its ability to pay for Services will be affected. Any information provided by the Network User to the Distributor under this clause 1.11 will be Confidential Information.
Network User. The Provider grants to you a non-exclusive license to use one copy of TheEasy Accounting System (hereinafter called The Software) included in this package on a Licensed Local Network system. The user terminals access The Software exclusively through one file server. The Software may not be installed for use on more than one file server. For the purpose of this section , “use” means loading The Software into RAM, as well as installation on a hard disk or other storage device. You may access The Software from a hard disk, over a network , or any other method , so long as you comply with The Agreement. The Agreement granted includes both a license for all software owned by The Provider and included in The Software and a sublicense for all software (if any) owned by a third party and included in The Software, as to which The Provider has acquired the original license.
Network User. (a) Network User may with the consent in writing of TasNetworks transfer or assign this agreement and TasNetworks will not unreasonably withhold its consent in circumstances where: (i) Network User requests the consent of TasNetworks to the transfer or assignment to the proposed assignee in writing; (ii) Network User has provided to TasNetworks any information reasonably required by TasNetworks regarding the proposed assignee or transferee; and (iii) the proposed assignee or transferee is a responsible and solvent person with sufficient financial, business and technical capacity to successfully carry out the obligations of Network User under this agreement. (b) If TasNetworks consents to such transfer or assignment it may (in addition to any other reasonable conditions) require such transfer or assignment to be conditional upon satisfaction of each of the following: (i) the proposed assignee or transferee first obtaining all licences and permits required of Network User under all laws and the Rules and the proposed assignee or transferee having otherwise complied with the requirements of the Rules; (ii) Network User not being not in default under this agreement and before settlement of any transfer or assignment paying to TasNetworks moneys outstanding to TasNetworks under this agreement; and (iii) the proposed assignee or transferee executing a deed of assignment or novation of this agreement in a form acceptable to TasNetworks acting reasonably.

  • Network Upgrades The Transmission Owner shall design, procure, construct, install, and own the Network Upgrades described in Attachment 6 of this Agreement. If the Transmission Owner and the Interconnection Customer agree, the Interconnection Customer may construct Network Upgrades that are located on land owned by the Interconnection Customer. Unless the Transmission Owner elects to pay for Network Upgrades, the actual cost of the Network Upgrades, including overheads, shall be borne initially by the Interconnection Customer.

  • Network Access During its performance of this Contract, Contractor may be granted access to Purchaser’s computer and telecommunication networks (“Networks”). As a condition of Network use, Contractor shall: (a) use the Networks in compliance with all applicable laws, rules, and regulations; (b) use software, protocols, and procedures as directed by Purchaser to access and use the Networks; (c) only access Network locations made available to Contractor by Purchaser; (d) not interfere with or disrupt other users of the Networks;

  • Network PHARMACY is a retail, mail order or specialty pharmacy that has a contract to accept our pharmacy allowance for prescription drugs and diabetic equipment or supplies covered under this plan. NETWORK PROVIDER is a provider that has entered into a contract with us or other Blue Cross and Blue Shield plans. For pediatric dental care services, network provider is a dentist that has entered into a contract with us or participates in the Dental Coast to Coast Network. For pediatric vision hardware services, a network provider is a provider that has entered into a contract with EyeMed, our vision care service manager.

  • Network Services Preventive care: 100% coverage. Preventive services include, but are not restricted to routine physical exams, routine gynecological exams, routine hearing exams, routine eye exams, and immunizations. A $100 single and $200 family combined annual deductible will apply to lab/diagnostic testing after which 100% coverage will apply. A $50 copay will apply to CT and MRI scans.

  • NON-NETWORK PROVIDER is a provider that has not entered into a contract with us or any other Blue Cross and Blue Shield plan. For pediatric dental care services, non-network provider is a dentist that has not entered into a contract with us or does not participate in the Dental Coast to Coast Network. For pediatric vision hardware services, a non-network provider is a provider that has not entered into a contract with EyeMed, our vision care service manager.
