Common use of Notification to the Union Clause in Contracts

Notification to the Union. The Employer will inform the Union and the JHSC within three (3) days of any ONA member who has been subjected to violence while performing his/her work. Such information, providing details set out in Section 5 of the Regulation for Health Care and Residential Establishments, shall be submitted in writing to the Union as soon as possible but in no case longer than four (4) days of becoming aware. For critical injuries the Employer will notify the Joint Health and Safety Committee and the Union immediately, and in writing, providing details set out in Section 5 of the Regulation for Health Care and Residential Establishments, within forty-eight (48) hours.

The Employer will inform the Union an ONA Occupational Health and the JHSC Safety Representative via electronic incident reporting system within three (3) days of any ONA member employee who has been subjected to violence while performing his/her their work. Such information, providing details set out in Section 5 of the Regulation for Health Care and Residential Establishments, shall be submitted in writing to the Union as soon as possible but in no case longer than four (4) days of becoming aware. For critical injuries the Employer employer will notify the Joint Health and & Safety Committee and the Union immediately, immediately and in writing, providing details set out in Section 5 of the Regulation for Health Care and Residential Establishments, Establishments within forty-eight (48) 48 hours. The employer in conjunction with the JHSC will immediately and thoroughly investigate all acts and reports of potential/ actual violence and forthwith take every precaution reasonable in the circumstance to prevent violence from occurring.
