Office Space Not Timely Available. If we are unable to make the particular segment of the Space listed on your Initial Invoice available by the Start Date, Phase Two will attempt to provide you with an equivalent or superior location (at the same cost) and Phase Two shall relocate you to your designated segment once available. If the segment of the Space is not made available to you within 60 days of the Start Date, you may terminate this Agreement by providing us with notice of such termination at any time following the expiration of such 60-day period and before the segment of Space is made available to you. Upon timely notice of termination Phase Two will Immediately accept this notice of termination and refund any funds then owing.
