The Official Personnel File clause defines what constitutes an employee's primary employment record maintained by the employer. This clause typically specifies which documents are included in the official file, such as performance reviews, disciplinary actions, and employment agreements, and may outline who has access to the file and under what circumstances. Its core practical function is to ensure that there is a single, authoritative source of employment records, thereby promoting transparency and consistency in personnel management and resolving disputes regarding employment history or actions.
Official Personnel File. Only one (1) official personnel file shall be kept for each employee at the appropriate personnel office. Records of previous discipline not found in the official personnel file cannot be used against an employee in any future disciplinary proceeding. Grievances shall not be kept in the employee’s official personnel file. Employees shall be informed as to where their personnel file is maintained.
Official Personnel File. An official personnel file for each unit member shall be maintained at the College in the Human Resource Office.
Official Personnel File. A. The Office of Human Resources must keep the County’s official personnel file for each employee. The official personnel file must not contain any information about an employee’s medical or psychological condition.
B. The documents in the official personnel file are limited to:
1. application for employment or promotion that resulted in appointment or promotion;
2. employment history, including personnel action documents affecting appointment, promotion, transfer, salary change, or other personnel action;
3. employee identifying information and emergency contact information;
4. payroll withholding documents;
5. insurance, retirement, and other records related to employee benefits;
Official Personnel File. The Superintendent or designee shall maintain the bargaining unit member's official personnel file. Except as provided in Section 4.16, material contained in the official personnel file can be utilized in the suspension or discharge of a bargaining unit member. This section is inapplicable to action taken pursuant to Section 24-11 of the Illinois School Code. No formal evaluation material and no letter of reprimand or letter of complaint shall be placed in the personnel file unless the bargaining unit member has an opportunity to read such material. The bargaining unit member shall be requested to acknowledge in writing that the material has been read by affixing their signature. If the bargaining unit member refuses to acknowledge the material being read, the material may nevertheless be placed in the file if the bargaining unit member has had the opportunity to read the material. The bargaining unit member shall have the right to respond to any material contained in the personnel file, and the response shall become a part of the file. The bargaining unit member shall have the right to review the contents of the personnel file within two (2) working days and shall have the right to have a representative of the Association accompany the review. Privileged information, as defined by law, shall be specifically exempted from such a review. The bargaining unit member may request and receive one (1) copy of any material contained in the personnel file except privileged information. The expense of the copy will be borne by the bargaining unit member.
Official Personnel File. The University's Campus Human Resources Office maintains the official personnel file for bargaining unit employees. When any document related to disciplinary action is placed in an employee's official personnel file, the University shall furnish the employee with a copy of that document.
Official Personnel File. There shall be one official personnel file and that file shall be kept in the College’s Human Resources Office. The Official Personnel File shall include, but may not be limited to, the following:
A. Applications and/or Resumes
B. Position description of the position held by the employee C. Classification studies of the position held by the employee D. Performance Evaluations
Official Personnel File. There shall be only one official personnel file for each employee. The official file shall be maintained by the Human Resource Department. No separate personnel file will be maintained by the Police Department or supervision within that Department; however, an employee development file may be maintained. A copy of all documents relating to conduct, discipline or job performance shall be given to the employee at the time of its placement in the official file. If an employee requests, copies of commendations, letters of appreciation, and like matters concerning an individual employee will be placed in the employee’s personnel file and shall be maintained until the time the file is disposed after separation from employment.
Official Personnel File. Each University shall maintain an Official Personnel File for each member of the bargaining unit, which shall be kept in a secure place in the custody of the President. Such file shall contain a continuous record of the unit member's status as an employee of the University within the DGCE unit. For the purposes of this Agreement, Official Personnel Correspondence shall mean correspondence from the Board of Trustees or from the Administration of any University to or concerning a member of the bargaining unit which is stamped “Official Personnel Correspondence” and which gives notice of any personnel action taken or proposed to be taken or of any official commendation, reprimand or disciplinary action. The Official Personnel File shall contain the following:
i. copies of Official Personnel Correspondence and personnel actions concerning the unit member;
ii. except as is hereinafter provided, all evaluations of the performance of the unit member made prior to the effective date of this Agreement and made thereafter pursuant to the provisions of Article IX hereof; provided only that the record of any student evaluations may be kept in the form of summaries thereof; and
iii. an updated official transcript submitted pursuant to the provisions of Article IX hereof. Except as is hereinafter provided, no other materials shall be included therein. All materials placed in the Official Personnel File of a unit member shall be stamped “Official Personnel Correspondence,” dated when received and numbered sequentially, and all materials contained in each Official Personnel File shall be logged sequentially and a copy of each document forwarded to the respective unit member. Unit members shall have the right without undue delay to examine their Official Personnel File. Under no circumstances shall the Official Personnel File be removed from its place of safekeeping by the unit member, and access to the Official Personnel File shall, where feasible, be only in the presence of someone in authority. Unit members shall have the right to place in their Official Personnel File a written statement made in response to materials that are contained in the File or that may affect their employment status. Upon written request of the individual member of the bargaining unit, the University administration shall reproduce, without undue delay, one (1) copy of such materials. Within sixty (60) days following the conduct of the seventh (7th) evaluation of the unit member at the University...
Official Personnel File. A. Only one complete official departmental personnel file shall be maintained for each employee at a location identified by each State department head or designee.
B. An employee or his/her representative, if properly authorized by the employee, shall have the right to review and to obtain copies of any material in his/her official personnel file during regular personnel office hours with appropriate prior notice.
C. The official personnel file shall not be moved from the identified location unless approved by the State department head or designee.
D. Where the official personnel file is in a location remote from the employee's work location, arrangements may be made to have a complete copy of the file sent to a location specified in writing by the employee.
E. The State shall maintain the official personnel file as a confidential record which should be available for inspection only to the employee's immediate supervisor or the direct higher line supervision or other persons authorized by the department head or designee.
F. An employee shall be provided, on a timely basis, with a copy of any performance•related material in his/her official personnel file.
G. An employee shall have the right to prepare and have entered into his/her official personnel file his/her written response to any performance-related material which is in his/her official personnel file.
H. Except the performance appraisal report, probationary reports and adverse actions, any negative performance-related material shall be removed from the employee's personnel file and destroyed within one (1) year from the date of entry, if there has been no further documentation of the same or similar behavior. When an employee receives written documentation of a negative nature, the supervisor shall note in writing the time frame it will remain in the file, if less than one (1) year.*
I. An employee shall have the right to request in writing, at any time, the removal of any performance-related material in his/her official personnel file. The State shall provide a written response if such request is denied. *These timeframes are effective upon ratification by both parties.
Official Personnel File member. The Official Personnel File shall be available for inspection by the DGCE Chair, the ▇▇▇▇, the Vice President, the President of the University, the Board of Trustees and the Board and, when so authorized in writing by the unit member, by a representative of the Association. An inspection sheet shall be maintained for each unit member's Official Personnel File. Whenever any person or body inspects the Official Personnel File of a unit member, the name of the individual or individuals conducting such inspection and the date and time thereof shall be noted on the inspection sheet. Unless required by law, no other person or agency shall be given access to an Official Personnel File without the express written permission of the unit member concerned.
