The Operating Capacity clause defines the minimum level of operational ability or output that a party, typically a service provider or manufacturer, must maintain under the agreement. It often specifies measurable standards, such as production volume, staffing levels, or equipment availability, to ensure that the party can meet its contractual obligations. This clause helps prevent disruptions by ensuring that the necessary resources and capabilities are consistently available, thereby reducing the risk of non-performance or service delays.

Operating Capacity. ‌ 2.7.1 Where change is proposed to maximum operating capacity for a site, the Department will consult with NZNO on the impact of such a change, including appropriate staffing arrangements. Consultation includes reasonable time for NZNO to respond to the proposal and taking their views into account before any decision is finalised.

Tenant hereby acknowledges that the premises they have reserved may include a pool and the undersigned agrees and acknowledges that the pool and patio/deck can be dangerous areas, that the deck/patio can be slippery when wet, and that injury may occur to anyone who is not careful. With full knowledge of the above facts and warnings, the undersigned Tenant accepts and assumes all risks involved to Tenant and all of Tenant's guests in or related to the use of the community pool and patio areas.

  • Maximum Capacity The Sick Leave Bank shall accumulate unused Bank days from year to year to a maximum capacity which shall not exceed double the number of eligible employees as defined in the above Section C, Eligibility for Membership.

  • INDEPENDENT CAPACITY The employees or agents of each party who are engaged in the performance of this Agreement shall continue to be employees or agents of that party and shall not be considered for any purpose to be employees or agents of the other party.

  • Power and Capacity Each Shareholder has the power, authority and capacity to enter into this Agreement and to consummate the transactions contemplated hereby. This Agreement constitutes each Shareholder’s valid, legal and binding obligation and is enforceable against such Shareholder in accordance with its terms, subject, however, as to enforcement, to bankruptcy, insolvency, fraudulent transfer, moratorium and similar laws of general applicability relating to or affecting creditors’ rights;
