Operation of State Laws Clause Samples
The 'Operation of State Laws' clause defines how state laws will govern the interpretation and enforcement of a contract or agreement. Typically, this clause specifies which state's laws apply in the event of a dispute, regardless of where the parties are located or where the contract is performed. For example, a contract between parties in different states may designate the laws of one particular state to avoid confusion. This clause ensures legal clarity and predictability by preemptively resolving potential conflicts over which jurisdiction's laws should apply.
Operation of State Laws. In any State in which any statute or regulation relating to apprentices is in force, that statute and regulation will operate in that State provided that the provisions of the statute or regulation are not inconsistent with this award in which case the provisions of this award will apply.
Operation of State Laws. Subject to the Workplace Relations Act, if any Victorian statute or regulation relating to apprentices is in force, that statute and regulation will operate provided that the provisions of the statute or regulation are not inconsistent with this Agreement in which case the provisions of this Agreement will apply.

11.4.2(a) Where it is consistent with State legislation, an apprentice may be engaged under a Training Agreement approved by an Apprenticeship Authority, provided the qualification outcome specified in the Training Agreement is consistent with that established for apprenticeship in the trade training package determined from time to time by the Utilities Industry Training Advisory Board and endorsed by the National Training Framework Committee.

(i) Where it is consistent with State Legislation, an apprentice may be engaged under a Training Agreement or Contract of Training approved by the relevant State or Territory Authority, provided the qualification outcome specified in the Training Agreement or Contract of Training is consistent with that established for the vocation in the training package determined from time to time by the Manufacturing Industry Skills Council (MISC) or its successors and endorsed by the relevant Training Authority or, is consistent with the qualifications established for electrical vocations within the relevant electrical/utilities Training Package endorsed by the National Training Quality Council or its successor.
(ii) Subject to(a) of this sub-clause, an apprenticeship may be undertaken in any of the following trades:
Operation of State Laws. Victorian statutes and regulation dealing with apprentices apply to the extent they are not inconsistent with this agreement in which case the provisions of this agreement will apply.
Operation of State Laws. 70.13.1 Any Victorian statute or regulation relating to apprentices now or hereafter in force shall operate provided that the provisions thereof are not inconsistent with this Agreement.
70.13.2 The provisions of any statute, award, regulation relating to the attendance of apprentices at technical school during ordinary working hours or to disciplinary powers of the apprenticeships authority over apprentices and employers, shall not be deemed to be inconsistent with this Agreement.

In any state in which any statute relating to apprentices is now or hereafter in force or in which any authority with statutory power has issued or may issue any regulation relating to apprentices such statute and such relations shall operate in such state provided that the provisions thereof are not inconsistent with this agreement.
3.8.1.2. The provision of any statute, agreement or regulation relating to the attendance of apprentices at technical school during ordinary working hours or to disciplinary powers of apprenticeship authorities over apprentices and employers shall not be deemed to be inconsistent with this agreement.

(ii) Subject to (a) of this subclause, an apprenticeship may be undertaken in any of the following trades:
(1) Engineering Tradesperson (Mechanical)
(2) Engineering Tradesperson (Fabrication)
(3) Engineering Tradesperson (Electrical/Electronic)
(4) Higher Engineering Tradesperson and Advanced Engineering Tradesperson
(A) The duration and pay for these apprenticeships are dealt with in Schedule D.
(B) The classification on completion of a Higher Engineering Tradesperson apprenticeship will be as a minimum C10. Where the apprentice is offered employment at the completion of their apprenticeship and such employment is in the area of the apprenticeship training, such that they are exercising or will be required to exercise the skills and knowledge gained during their apprenticeship necessary for a C7 level of work they shall be classified at C7.
(C) The training program for each Higher Engineering Tradesperson apprentice is to be consistent with the minimum training requirement for the classification of C7 Special Class Tradesperson, as determined from time to time by the Manufacturing Industry Skills Council (MISC), and as endorsed by the National Training Quality Council. Each apprentice shall also complete the requirements for a trade certificate as defined in (c)(i), as part of the training program leading to the completion of the Certificate IV in Engineering.

Operation of State Laws. 16(a) In any state in which any statute relating to apprentices is now or hereafter in force or in which any authority with statutory power has issued or may issue any regulation relating to apprentices such statute and such relations shall operate in such state provided that the provisions thereof are not inconsistent with this Agreement.
Operation of State Laws. Applicable Victorian statute and regulation will apply to apprentices, provided that the provisions of the statute or regulations are not inconsistent with this Agreement in which case the provisions of this Agreement will prevail. Where it is consistent with State legislation, an apprentice may be engaged under a Training Agreement approved by an Apprenticeship Authority, provided the qualification outcome specified in the Training Agreement is consistent with that established for apprenticeship in the trade training packed determined from time to by the Utilities Industry Training Advisory Board and endorsed by the National Training Framework Committee.
