OPERATION OF THE PANEL. 4.1 The Panel is established and operated by EECA in accordance with the ITR (including any revisions of that ITR), and the Panel will continue for an initial period from the date of the first Panel agreement to 30 June 2028, unless:
(a) EECA, in its sole discretion, elects to discontinue the Panel earlier; or
(b) all LEHVF Funding is exhausted earlier.
4.2 EECA will commit the LEHVF Funding to eligible Customers in relation to the supply or conversion of Eligible Vehicles on a first in first served basis but subject to the caps on LEHVF Funding for the Supplier, Customers and hybrid vehicles, as provided for in this Agreement.
4.3 The Supplier acknowledges that EECA may undertake interim reviews of the Panel and the LEHVF during the term of this Agreement to ensure the Panel and LEHVF are fit for purpose. As a result of such reviews, the amount of LEHVF Funding available and caps on LEHVF Funding (including as set out in clauses 8 and 9) may change at EECA’s sole discretion by notice from EECA to the Supplier and this Agreement will be deemed to be amended accordingly (without any action required of the Supplier).

7.1 The Panel Chairman shall be the Panel Member appointed as such, from time to time, by a simple majority of the Panel Members.
7.2 The Panel Chairman may at any time be removed from the office of Panel Chairman by a simple majority of the Panel Members or at the direction of the Authority. Where a Panel Member is removed from the office of Panel Chairman he may not be reappointed as such without the Authority’s prior consent.
7.3 The Panel Chairman shall preside at every meeting of the Panel at which he is present. If the Panel Chairman is unable to be present at a meeting, he may nominate, by notice in writing to the Panel Secretary, another Panel Member (or his Alternate) to act as Panel Chairman for that meeting. If neither the Panel Chairman nor any person nominated by him in accordance with this Clause 7.3 is present at a Panel meeting, the Panel Members present may, by simple majority, appoint any one of their number to preside at that meeting.
7.4 The Panel Chairman shall be entitled to vote in his capacity as a Panel Member. The Panel Chairman shall in no circumstances be entitled to an extra or casting vote.

OPERATION OF THE PANEL. 12. The chairperson of the panel shall preside at all its meetings. The panel may delegate to the chairperson the authority to make administrative and procedural decisions.
13. Unless otherwise provided in Chapter [X] (Dispute Settlement) or in these Rules of Procedure, the panel may conduct its activities by any means, including telephone, facsimile transmissions or computer links.
14. Only panellists may take part in the deliberations of the panel, but the panel may permit their assistants to be present at its deliberations.
15. The drafting of any decision and report shall remain the exclusive responsibility of the panel and shall not be delegated.
16. Where a procedural question arises that is not covered by the Chapter [X] (Dispute Settlement) and its Annexes, the panel, after consulting the Parties, may adopt an appropriate procedure that is compatible with those provisions.
17. When the panel considers that there is a need to modify any of the time periods for the proceedings other than the time periods set out in Chapter [X] (Dispute Settlement) or to make any other procedural or administrative adjustment, it shall inform the Parties, in writing and after consultation of the Parties, of the reasons for the change or adjustment and of the time period or adjustment needed.

The Conduct of Proceeding of the Panel shall be in accordance with rules, which may be established from time to time by mutual agreement between the parties, the most recent version of which is attached as “Appendix During the Hearing, only the Arbitrator, members of the Panel hearing the case, parties presenting the case and the Coordinator shall be allowed to sit in the immediate area where the Hearing is being conducted. Any other observers shall only be allowed to be present where specifically granted permission by the Coordinator of the Panel. The Panel shall make all decisions in an executive session after each individual case has been heard, While in Executive Session only Panel members and the Coordinator will be in attendance. After each decision is reached by the Arbitrator and Panel, the Arbitrator will issue the Award on the Award Form provided for this purpose and it shall be signed by the Arbitrator and members of the Panel and filed with the Coordinator.

(B) During the Hearing, only the members of the Panel hearing the case, parties presenting the case and the Coordinator shall be allowed to sit in the immediate area where the Hearing is being conduc ▇▇▇. Any other observers shall only be allowed to be present where specifically granted permission by the Coordinator of the Panel.
(C) The Panel shall make all decisions in an executive session after each individual case has been heard. While in Executive S ession only Panel members and the Coordinator will be in attendance.
(D) After each decision is reached by a majority of the Panel, the Panel will issue their Award on the Award Form provided for this purpose and it shall be signed by the members of the Panel and filed with the Coordinator.
(E) The Coordinator will mail decisions within 48 hours of the Hearing. No decisions will be given the day of the Hearing.

All authorized expenses incurred on behalf of or in the name of The Canadian Joint Grievance Panel shall be paid jointly by all attending parties. Rules and Regulations may be changed or amended by mutual agreement of the participating parties. Cancellation fees will be assessed in the following manner:

OPERATION OF THE PANEL. The Panel shall adopt rules of procedure for its operations at its first meeting. After each meeting a report of infractions and related matters shall be made available to the public. The Panel will prepare an annual report on its activities. The proceedings of the Panel will not be public, and its members shall not divulge any information concerning individual vessels and operators derived from review forms or from the proceedings of the Panel. In- formation concerning compliance with the terms of the Agreement will be made public by means of the Panel's Re- ports.
