Operational Phase Clause Samples

The Operational Phase clause defines the period during which the agreed-upon services or activities are actively carried out under the contract. This clause typically outlines the responsibilities, performance standards, and procedures that apply once the project or service moves from planning or construction into day-to-day operation. For example, it may specify maintenance obligations, reporting requirements, or performance monitoring processes. Its core function is to establish clear expectations and guidelines for both parties during the ongoing operation, ensuring that the project or service is managed effectively and contractual obligations are met.
Operational Phase. During the Operations Phase, Design Builder shall: 1. Provide assistance in connection with the start-up, testing, refining and adjusting of any equipment or system. 2. Assist Owner in training staff to operate and maintain the Project. 3. Assist Owner in developing systems and procedures for control of the operation and maintenance of and record keeping for the Project.
Operational Phase. During the operational phase, DESIGN/BUILDER shall: 1. Provide assistance in connection with the start-up, testing, refining and adjusting of any equipment or system included in the Work. 2. Assist OWNER in training staff to operate and maintain the Project as provided in Exhibit G. Other than assistance normally provided in the industry after final payment, nothing in this paragraph 6.01.E. shall be interpreted or construed as obligating DESIGN/BUILDER to perform or provide such assistance to OWNER after final payment and acceptance of the Work under paragraph 13.08 below.
Operational Phase. Accordingly, the responsibilities and deliverables are broadly divided in these four phases.
Operational Phase. Operational Phase shall mean the time period after the Operational Go-Live of the AMI system till the end of Contract Period. Detailed Scope and responsibilities of the AMISP under this Phase is provided in Schedule F to this Contract.
Operational Phase. The terms, conditions, and provisions of this AGREEMENT relating to turnover plans shall apply.
Operational Phase. 5.12.2.1 The potential sources of water quality impacts during the operational phase would be related to non-point source surface / irrigation runoff, routine maintenance works (maintenance desilting and minor maintenance to DWFI system), potential changes in hydrodynamics properties and hydrology, and water quality impact from riparian public open space (including operation of UV disinfection system and water play features in amenity area). Adequate drainage system with silt traps and oil interceptors should be be incorporated into the proposed works to collect the surface / irrigation runoff or runoff from riparian public open space. With proper design of drainage system and implementation of the recommended pollution control measures, no adverse water quality impact from non-point source surface / irrigation run-off or runoff from riparian public open space would be expected. No adverse water quality impacts would be expected to occur at any identified WSRs due to the small- scale and infrequent routine maintenance works to remove excessive silts, debris and any obstructions for safeguarding the hydraulic capacity of the nullah, which practices and frequencies would be similar to the ones undertaken by DSD along TWN under existing arrangement. 5.12.2.2 Despite the reduced environmental baseflow at the nullah due to the interception of the flow with polluted discharges by the DWFI system, owing to the natural sloping gradient along TWN and the water retention and replenish designs and ecological enhancement features (e.g. wetland habitats created) within the nullah, average flow rate would remain similar to baseline condition and no unacceptable impacts on hydrodynamics properties and hydrology would be anticipated. No adverse water quality impact during the operational phase would therefore be anticipated. 5.12.2.3 While the Project is expected to improve the overall water quality of TWN and environmental monitoring and audit for water quality is not considered necessary for the operational phase under this EIA study, a post-revitalisation water quality monitoring programme to review compliance with the Water Quality Goals as stipulated in DSD PN No. 3/2021 will be establised and implemeneted by the DSD.
Operational Phase i. Operation and maintenance of DPC comprising of destoning & pre-cleaning, moisture testing, weighing and loading to truck by deploying adequate manpower. All required support infrastructures, utilities, consumables etc. are to be arranged by the SPV. ii. Operation & maintenance of the mill and storage facilities. iii. Collection of paddy from Authority at DPCs. iv. Transportation of paddy from DPCs to mill. v. Drying of paddy using post-harvest dryers. vi. Storing of dried paddy in the silos / modern warehouses. vii. Hulling of paddy and production of rice as per the quality specifications fixed by Authority. viii. Packing of rice in 5 kg, 10 kg, 15 kg, 25 kg, 35 kg and 50 kg bags as stipulated by Authority. ix. Loading and transportation of rice bags to the godowns specified by Authority within 50 km radius of the mill location. x. The Authority shall pay the applicable transportation charges for movement of paddy from DPCs to mill and movement of rice from mill to godowns as per the schedule of rates approved by the State Level Committee (SLC) based on the guidelines of Government of India.
