Overtime Rotation. A. The Head of each Department for purposes of overtime assignment shall promulgate and post a list of employees who are best able to operate identified equipment and/or perform certain tasks and responsibilities consistent with the employee’s job classification, The City Manager, Department Head and Union President shall consult with respect to the listed employees. An employee who believes that he/she should be included on a particular list may request that the Department Head provide a statement of the reason why the employee was not included on the list and steps the employee needs to take to be included on the list. The Department Head’s decision on the listing of employees for purposes of overtime shall not be unreasonable, and shall not be subject to review pursuant to the grievance arbitration procedure. 1. 3. All employees will be assigned by the Township on a rotational basis to respond to “on-call” assignments after 3:30 PM and on Saturdays, Sundays, and paid holidays. If the employee is not available for subsequent call back assignments within the four hour period, the employee shall not receive the four hour minimum call back pay, but shall receive out times stated above in the case of multiple call back pay only for time actually worked during the call back period. If the employee actually works more than four hours outs on call back, the employee shall be entitled to call back pay for hours actually worked. An employee called back to work less than four hours prior to the start time of his/her regular work shift shall be paid at the applicable overtime rate for the time period commencing with the start of the call back to the scheduled start time of his/her work shift.

Overtime Rotation. A. Overtime shall be assigned in accordance with the seniority list, which shall set forth the names of Employees in each classification, in order of their seniority. The Head of each Department for purposes of first overtime assignment on a particular occasion shall promulgate be assigned to the most senior employee on the seniority list in that classification. If the most senior employee is unwilling to accept the overtime assignment, the next most senior employee shall have an opportunity to accept that assignment. Overtime assignments will proceed down the seniority list. If an Employee to whom the assignment has been offered declines to accept that assignment, he/she will be passed, and post a list of will not be offered any overtime assignments until his/her turn is reached again. If the Employee is offered an overtime assignment and is unable to perform the assignment because he/she is not qualified to do the work assigned, he/she will be offered the next overtime assignment for which he/she is qualified. In the event that all employees who are best able offered a particular overtime assignment decline to operate identified equipment and/or perform certain tasks and responsibilities consistent with accept the employee’s job classificationassignment, The City Manager, Department Head and Union President shall consult with respect to the listed employees. An least senior employee who believes that he/she should be included on a particular list may request that is offered the Department Head provide a statement of the reason why the employee was not included on the list assignment and steps the employee needs to take to be included on the list. The Department Head’s decision on the listing of employees for purposes of overtime shall not be unreasonable, and shall not be subject to review pursuant to the grievance arbitration procedure.
1. Employees shall be assigned overtime work to be performed based on the work needed to be perfonned and the use of the appropriate list of employees, with seniority determining the order in which employees on the appropriate list will be assigned the overtime.
2. The foregoing shall apply unless the overtime assignment involves holding employees from their usual work shift, in which case employees who had been performing the necessary job functions during their work shift will continue is qualified to perform the work on assignment shall be obliged to accept it. No Employee will be permitted to accept an overtime basis.
3. If assignment if the Department Head is Employee does not able to secure sufficient number of employees to perform possess the overtime work, the Department Head may take whatever steps he/she deems necessary, including the hire of person(s) outside the bargaining unit, skill and ability to perform the work. Use All determinations as to qualifications for overtime assignments shall be at the discretion of employees from outside the bargaining unitSuperintendent of Public Works.
I. Due to the important and emergent nature of work to be performed, if the Superintendent of Public Works or his designee reaches an employee’s answering machine, the employee must return the call within 15 minutes to be eligible for purposes the overtime assignment. Failure to do so will result in the employee being passed over in the rotation.
J. Any employee may, at his/her option indicate at the time overtime is assigned that he/she wishes to take compensatory time (at time and one half) in lieu of overtime as described herein shall monetary payment. Once made, however, this decision may not be changed. Further, employees may only accumulate up to 80 hours of compensatory time in a precedent calendar year and they must utilize all compensatory time earned within that calendar year by 12/31 of each year or considered relevant to any issue between the City and the Union regarding exclusive perfomiance of bargaining unit work by members of the CSEA bargaining unit.
4. In the event the Department Head fails to assign overtime in accordance with the foregoing, the employee(s) who should have received the overtime assignment time will be offered the next available overtime assignment for which the employee is qualified and able to work.

Notwithstanding tills requirement, where an employee is unable to provide the required notice due to an unusual, unforeseen frame and unforeseeable emergency circumstance, the employee shall make the written request as soon as the employee is aware of the need procedure for emergency compensatory time off and the employee shall include in the written request information with respect to the emergency criteria. Any request for use of compensatory time off is subject to the approval of the Department Head or designee, which approval shall not be unreasonably withheld. 1/19/18
B. Shift Differential A shift differential in the amount of $1.25 per hour shall be paid to second shift employees and a shift differential in the amount of $1.75 per hour shall be paid to third shift employees. Overtime work by these employees shall be paid at employee’s annual rate of pay, excluding the differentialpersonal days.
